| 1 | AMENDMENT TO HOUSE BILL 3385 | ||||||
| 2 | AMENDMENT NO. ______. Amend House Bill 3385 by replacing | ||||||
| 3 | everything after the enacting clause with the following: | ||||||
| 4 | "Section 5. The Mental Health Early Action on Campus Act | ||||||
| 5 | is amended by changing Sections 30 and 40 as follows: | ||||||
| 6 | (110 ILCS 58/30) | ||||||
| 7 | Sec. 30. Training. | ||||||
| 8 | (a) The board of trustees of each public college or | ||||||
| 9 | university must designate an expert panel to develop and | ||||||
| 10 | implement policies and procedures that (i) advise students, | ||||||
| 11 | faculty, and staff on the proper procedures for identifying | ||||||
| 12 | and addressing the needs of students exhibiting symptoms of | ||||||
| 13 | mental health conditions, (ii) promote understanding of the | ||||||
| 14 | rules of Section 504 of the federal Rehabilitation Act of 1973 | ||||||
| 15 | and the federal Americans with Disabilities Act of 1990 to | ||||||
| 16 | increase knowledge and understanding of student protections | ||||||

| |||||||
| 1 | under the law, and (iii) provide training if appropriate. | ||||||
| 2 | The expert panel shall be comprised of at least 2 | ||||||
| 3 | administrators, 2 members of faculty, and one mental health | ||||||
| 4 | professional. | ||||||
| 5 | (b) The Technical Assistance Center under Section 45 shall | ||||||
| 6 | set initial standards for policies and procedures referenced | ||||||
| 7 | in subsection (a) to ensure statewide consistency. | ||||||
| 8 | (c) All resident assistants in a student housing facility, | ||||||
| 9 | advisors, and campus security of a public college or | ||||||
| 10 | university must participate in a national Mental Health First | ||||||
| 11 | Aid training course or a similar program prior to the | ||||||
| 12 | commencement of their duties. Training must include the | ||||||
| 13 | policies and procedures developed by the public college or | ||||||
| 14 | university referenced under subsection (a). | ||||||

| 17 | Sec. 40. Local partnerships. | ||||||
| 18 | (a) Each public college or university must form strategic | ||||||
| 19 | partnerships with local mental health service providers to | ||||||
| 20 | improve overall campus mental wellness and augment on-campus | ||||||
| 21 | capacity. The strategic partnerships must include linkage | ||||||
| 22 | agreements with off-campus mental health service providers | ||||||
| 23 | that establish a foundation for referrals for students when | ||||||
| 24 | needs cannot be met on campus due to capacity or preference of | ||||||
| 25 | the student. The strategic partnerships must also include (i) | ||||||

| 1 | avenues for on-campus and off-campus mental health service | ||||||
| 2 | providers to increase visibility to students via marketing and | ||||||
| 3 | outreach, (ii) opportunities to engage the student body | ||||||
| 4 | through student outreach initiatives like mindfulness | ||||||
| 5 | workshops or campus-wide wellness fairs, and (iii) | ||||||
| 6 | opportunities to support awareness and training requirements | ||||||
| 7 | under this Act. | ||||||
| 8 | (b) Through a combination of on-campus capacity, | ||||||
| 9 | off-campus linkage agreements with mental health service | ||||||
| 10 | providers, and contracted telehealth therapy services, each | ||||||
| 11 | public college or university shall attempt to meet a benchmark | ||||||
| 12 | ratio of one clinical, non-student staff member to 1,250 | ||||||
| 13 | students. However, each public college or university shall | ||||||
| 14 | provide at least 3 licensed mental health professionals or | ||||||
| 15 | less than 3 if the benchmark ratio falls under 3. The mental | ||||||
| 16 | health professionals must be employed by the public college or | ||||||
| 17 | university. Service hours for the mental health professionals | ||||||
| 18 | should be informed by campus utilization data and may include | ||||||
| 19 | in-person and telehealth modalities to ensure access to the | ||||||
| 20 | mental health professionals. If linkage agreements are used, | ||||||
| 21 | the agreements must include the capacity of students providers | ||||||
| 22 | are expected to serve within the agency. Two years after the | ||||||
| 23 | effective date of this Act, and once every 5 years thereafter, | ||||||
| 24 | the Technical Assistance Center developed under Section 45 | ||||||
| 25 | must propose to the General Assembly an updated ratio based on | ||||||
| 26 | actual ratios in this State and any new information related to | ||||||

| |||||||
| 1 | appropriate benchmarks for clinician-to-student ratios. The | ||||||
| 2 | updated benchmark must represent a ratio of no less than one | ||||||
| 3 | clinical, non-student staff member to 1,250 students. | ||||||
| 4 | (c) Each public college or university must work with local | ||||||
| 5 | resources, such as on-campus mental health counseling centers | ||||||
| 6 | or wellness centers, local mental health service providers, or | ||||||
| 7 | non-providers, such as affiliates of the National Alliance on | ||||||
| 8 | Mental Illness, and any other resources to meet the awareness | ||||||
| 9 | and training requirements under Sections 25 and 30 of this | ||||||
| 10 | Act. | ||||||
