AMENDMENT TO HOUSE BILL 2409

2    AMENDMENT NO. ______. Amend House Bill 2409 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The PFAS Reduction Act is amended by changing
5Section 5 and by adding Section 20 as follows:
 
6    (415 ILCS 170/5)
7    Sec. 5. Definitions. In this Act, unless the context
8otherwise requires:
9    "Agency" means the Illinois Environmental Protection
10Agency.
11    "Auxiliary firefighting personal protective equipment"
12means personal protective equipment other than firefighting
13personal protective clothing, including self-contained
14breathing apparatuses and other respiratory protection
15products, hearing protection, protective communication
16devices, and fall protection products.

1    "Class B firefighting foam" means foam designed to
2extinguish flammable liquid fires or prevent the ignition of
3flammable liquids.
4    "Fire department" means the duly authorized fire
5protection organization of a unit of local government, a
6Regional Fire Protection Agency, a fire protection district,
7or a volunteer fire department.
8    "Firefighting personal protective clothing" means any
9clothing designed, intended, or marketed to be worn by
10firefighting personnel in the performance of their duties,
11designed with the intent for use in fire and rescue
12activities, including jackets, pants, shoes, gloves, and
13helmets.
14    "Local government" means a unit of local government or
15other special purpose district that provides firefighting
16services.
17    "Manufacturer" means a person that manufactures Class B
18firefighting foam and any agents of that person, including an
19importer, distributor, authorized servicer, factory branch, or
20distributor branch.
21    "Perfluoroalkyl substance or polyfluoroalkyl substance" or
22"PFAS" means a class of fluorinated organic chemicals
23containing at least one fully fluorinated carbon atom.
24    "Person" means any individual, partnership, association,
25public or private corporation, limited liability company, or
26any other type of legal or commercial entity, including, but

1not limited to, members, managers, partners, directors, or
2officers.
3    "Testing" means calibration testing, conformance testing,
4and fixed system testing.

7    Sec. 20. Notification for firefighting personal protective
8clothing and equipment sales; prohibitions.
9    (a) Beginning January 1, 2026, any person, firm,
10association, partnership, corporation, organization, or joint
11venture, including an importer or domestic distributor of
12firefighting agents or firefighting equipment, that sells
13firefighting personal protective clothing containing PFAS
14chemicals to any person, local government, or State agency
15shall provide written notice to the purchaser at the time of
16sale which shall state: (i) that the firefighting personal
17protective clothing contains PFAS chemicals; and (ii) the
18reason PFAS chemicals are added to the clothing. The seller
19and the purchaser shall retain a copy of the notice required
20under this subsection on file for at least 3 years from the
21date of the purchase, and upon the request of the Agency, the
22seller shall furnish the notice, or written copies, and
23associated sales documentation to the Agency within 60 days of
24such request.
25    (b) Beginning January 1, 2027, a person that sells

1firefighting personal protective clothing to any person, local
2government, or State agency shall not knowingly manufacture,
3sell, offer for sale, distribute for sale, or distribute for
4use in the State any firefighting personal protective clothing
5containing intentionally added PFAS chemicals.
6    (c) Beginning January 1, 2030, a person that sells
7auxiliary firefighting personal protective equipment to any
8person, local government, or State agency shall not knowingly
9manufacture, sell, offer for sale, distribute for sale, or
10distribute for use in the State any auxiliary firefighting
11personal protective equipment containing intentionally added
12PFAS chemicals.".
