| 1 | AMENDMENT TO HOUSE BILL 1367 | ||||||
| 2 | AMENDMENT NO. ______. Amend House Bill 1367 on page 1, | ||||||
| 3 | line 17, by replacing "25" with "12"; and | ||||||
| 4 | on page 9, by replacing line 9 with the following: | ||||||
| 5 | "procedures under Section 115-20. However, the township board | ||||||
| 6 | may, without a referendum, sell, convey, or donate any part of | ||||||
| 7 | the open space to the Department of Transportation if: | ||||||
| 8 | (1) the conveyance is for road purposes; | ||||||
| 9 | (2) the Department of Transportation and the township | ||||||
| 10 | board hold at least one public hearing at which citizens | ||||||
| 11 | may review plans for the open space and provide public | ||||||
| 12 | comment. Notice of the public hearing shall be given at | ||||||
| 13 | least 20 days prior to the hearing and at least 30 days | ||||||
| 14 | prior to a vote by the township board. The notice shall be | ||||||
| 15 | given by public advertisement in a newspaper of general | ||||||
| 16 | circulation in the township and must also be sent to the | ||||||
| 17 | Governor and to each member of the General Assembly whose | ||||||
| |||||||
| |||||||
| 1 | district overlaps in whole or in part the open space | ||||||
| 2 | district; and | ||||||
| 3 | (3) the conveyance is approved by a two-thirds | ||||||
| 4 | majority vote of the township board members."; and | ||||||
| 5 | on page 9, by replacing lines 14 through 16 with the following: | ||||||
| 6 | "space purposes unless (i) the open space is disposed of using | ||||||
| 7 | the same procedures required under subsection (a) by the board | ||||||
| 8 | of the unit of local government in control of that open space | ||||||
| 9 | or (ii) the open space is sold, conveyed, or donated to a | ||||||
| 10 | nonprofit organization, the federal government, a state | ||||||
| 11 | government, or a local government to be used for open space | ||||||
| 12 | purposes.". | ||||||
