<SynopsisText>Replaces everything after the enacting clause. Amends the State Employee Indemnification Act and the Local Governmental and Governmental Employees Tort Immunity Act. Prohibits the State and local public entities from providing representation for or indemnifying any State or local employee in (i) any criminal proceeding in which the employee is a defendant or (ii) any criminal investigation in which the employee is the target (in the engrossed bill, the prohibition applies only to criminal proceedings arising out of the employee's employment with the State or local public entity). Provides that the State and local public entities are not prohibited from providing representation to an employee who is a witness in a criminal matter arising out of that employee's employment with the State or local government entity.</SynopsisText><synopsistitle>House Floor Amendment No. 2</synopsistitle>
<SynopsisText>Makes changes to the bill as amended by House Amendment 1 concerning indemnification of local public employees. Provides that a local public entity may reimburse the employee for reasonable defense costs only if the criminal action was instituted against the employee based upon an act or omission of that employee arising out of and directly related the lawful exercise of his or her official duty or under color of his or her authority and that action is dismissed or results in a final disposition in favor of that employee. Provides that those provisions of indemnification shall be justifiably refused by the local public entity if it is determined that there exists a policy of current insurance policy or a contract, by virtue of which the employee is entitled to a defense of the action in question. Changes the effective date from immediate to January 1, 2017.</SynopsisText></synopsis>
