Requires the Department of Labor to establish and administer a Family Leave Insurance Program that provides family leave insurance benefits to eligible employees who take unpaid family leave to care for a newborn child, a newly adopted or newly placed foster child, or a family member with a serious health condition. Sets forth eligibility requirements for benefits under the Act including that the employee must (i) establish that he or she has been employed for at least 680 hours in employment during the employee's qualifying year and (ii) document that he or she has provided the employer with written notice of the employee's intention to take family leave. Defines "employer" to mean (a) any person, partnership, corporation, association, or other business entity that employs 50 or more employees for each working day during each of 20 or more calendar workweeks in the year in which the leave is to be taken or in the year immediately preceding the year in which the leave is to be taken; and (b) the State of Illinois and any other unit of local government. Contains provisions concerning disqualification from benefits; premium payments; the amount and duration of benefits; the recovery of erroneous payments; hearings; defaulted premium payments; elective coverage; employment protection; coordination of family leave; defined terms; and other matters. Amends the State Finance Act. Creates the Family Leave Insurance Account Fund.House Committee Amendment No. 3 Excludes the State from the scope of the term "employer". Provides for the Act to be administered by the Department of Employment Security (rather than the Department of Labor).State Mandates Fiscal Note, House Committee Amendment No. 3 (Dept. of Commerce & Economic Opportunity) This bill does not create a State mandate.Fiscal Note, House Committee Amendment No. 3 (Dept. of Employment Security) Initial Start-Up Costs: Estimated at $75 million to $100 million, based on startup experience of our IBIS (Illinois Benefit Information System) which serves as the Illinois Department of Employment Security's benefit management platform for unemployment insurance. IBIS took multiple years to set up at a total cost of $125 million. It would be reasonable to expect a similar time frame for the UI-like benefit aspect of the FLIP program. Unlike the prior IBIS work, however, development of FLIP would also entail a revenue collection component. Cost incurred would also include the efforts of an estimated 5 to 10 full-time equivalents for the creation and establishment of rules, policies, procedures, etc. for reporting, claims-taking, adjudication and appeals. Ongoing Costs: Expected to be at least $46 million annually. Roughly 400 full time equivalents would be needed to administer the program, based on the staffing levels for similar programs as reported by New Jersey and California. The vast majority of the ongoing costs would be for the salary, benefits and administrative overhead for these positions. A significant amount of these costs ($6 million) are the estimated annual system-related costs. Two other cost categories of significance that are NOT included above are the costs of any new equipment and the postage costs for the program.
