| 2 | | WHEREAS, The United States Congress enacted the Federal |
| 3 | | Aviation Administration Modernization and Reform Act ("the |
| 4 | | Act"), which requires the Federal Aviation Administration to |
| 5 | | develop a plan to accelerate the integration of civil unmanned |
| 6 | | aircraft into the national airspace system by 2015; and
|
| 7 | | WHEREAS, An unmanned aircraft is operated without the |
| 8 | | possibility of direct human intervention or control from within |
| 9 | | or on the aircraft; and
|
| 10 | | WHEREAS, Unmanned aircraft are commonly referred to as |
| 11 | | drones; and
|
| 12 | | WHEREAS, New developments in technology allow the creation |
| 13 | | of increasingly smaller drones that are undetectable by the |
| 14 | | naked eye; and
|
| 15 | | WHEREAS, Following the passage of the Act, the Federal |
| 16 | | Aviation Administration has begun to issue rules to implement |
| 17 | | the Act's mandated plan, including rules that allow law |
| 18 | | enforcement agencies to operate drones; and |
| 19 | | WHEREAS, Allowing an increased amount of drones to fly in |
| 20 | | the national airspace expands aerial surveillance capabilities |

| 1 | | and has the potential to threaten the protected privacy rights |
| 2 | | of Illinois citizens; and
|
| 3 | | WHEREAS, It is imperative for the members of the Senate to |
| 4 | | thoroughly investigate the ramifications of the use of drones |
| 5 | | by law enforcement agencies and private parties in the State of |
| 6 | | Illinois; therefore, be it
|
| 7 | | RESOLVED, BY THE SENATE OF THE NINETY-EIGHTH GENERAL |
| 8 | | ASSEMBLY OF THE STATE OF ILLINOIS, that there is created the |
| 9 | | Drone Task Force, consisting of 17 members appointed as |
| 10 | | follows:
|
| 11 | | (1) two members of the Senate, one member appointed by |
| 12 | | the President of the Senate and one member appointed by the |
| 13 | | Minority Leader of the Senate; the member appointed by the |
| 14 | | President of the Senate shall serve as chair of the Task |
| 15 | | Force; |
| 16 | | (2) three members appointed by the Governor; and |
| 17 | | (3) twelve members who are not members of the General |
| 18 | | Assembly, 6 appointed by the Senate President and 6 |
| 19 | | appointed by the Senate Minority Leader, representing a |
| 20 | | range of interests, including law enforcement, trial |
| 21 | | attorneys, the Illinois State Bar Association, judges, |
| 22 | | business groups, municipalities, and the general public; |
| 23 | | and be it further |

| 1 | | RESOLVED, That all members shall serve without |
| 2 | | compensation, but may be reimbursed for actual expenses from |
| 3 | | funds appropriated for that purpose; and be it further |
| 4 | | RESOLVED, That the Task Force shall study the various ways |
| 5 | | in which drones are used, including, but not limited to, the |
| 6 | | use of drones for surveillance by law enforcement; the use of |
| 7 | | drones for surveillance by other government entities, |
| 8 | | including for enforcement of local ordinances and codes; the |
| 9 | | use of armed drones by law enforcement; the use of armed drones |
| 10 | | by private citizens or entities; and the use of drones for |
| 11 | | surveillance by private citizens or entities; and be it further |
| 12 | | RESOLVED, That the Task Force shall evaluate whether and |
| 13 | | how to limit the use of drones by law enforcement, other |
| 14 | | government entities, and private citizens or entities; and be |
| 15 | | it further |
| 16 | | RESOLVED, That, on or before January 1, 2014, the Task |
| 17 | | Force shall report to the President of the Senate, the Minority |
| 18 | | Leader of the Senate, and the Governor concerning its |
| 19 | | recommendations, which shall include proposed legislation to |
| 20 | | implement its recommendations, if needed; and be it further |
| 21 | | RESOLVED, That the Task Force shall be dissolved upon |
| 22 | | issuing its report.
