| 2 | | WHEREAS, The Illinois Environmental Protection Agency |
| 3 | | maintains jurisdiction over and has the authority to issue |
| 4 | | Beneficial Use Determinations for asphalt roofing shingles in |
| 5 | | the State of Illinois; and
|
| 6 | | WHEREAS, Senate Bill 1925 of this 98th General Assembly |
| 7 | | will require the Illinois Environmental Protection Agency to |
| 8 | | conduct an evaluation of an applicant's prior experience in |
| 9 | | asphalt shingle recycling operations prior to issuing a |
| 10 | | Beneficial Use Determination for asphalt shingles; and |
| 11 | | WHEREAS, In 2011, the Illinois Senate passed HB1326, now |
| 12 | | Public Act 97-0314, which authorized the Illinois Department of |
| 13 | | Transportation ("Department") to use recycled asphalt shingles |
| 14 | | in its hot mix asphalt projects; and
|
| 15 | | WHEREAS, The Department has developed an approval process |
| 16 | | for the acceptance of recycled asphalt shingles into hot mix |
| 17 | | asphalt projects; and |
| 18 | | WHEREAS, The Department uses recycled asphalt shingles in |
| 19 | | its hot mix asphalt projects; and
|
| 20 | | WHEREAS, The Senate believes that for new applications and |
|

| 1 | | renewals of recyclers it is necessary for the Department to |
| 2 | | develop a protocol to ensure that only responsible recyclers |
| 3 | | operating under appropriate permits and Beneficial Use |
| 4 | | Determinations issued by the Illinois Environmental Protection |
| 5 | | Agency are providing materials to the Department for its use; |
| 6 | | therefore, be it
|
| 7 | | RESOLVED, BY THE SENATE OF THE NINETY-EIGHTH GENERAL |
| 8 | | ASSEMBLY OF THE STATE OF ILLINOIS, that we urge the Department |
| 9 | | not to approve the production of hot mixes from recycled |
| 10 | | asphalt shingles, and not to use recycled asphalt shingles from |
| 11 | | a recycler in its projects, until the Department has received |
| 12 | | from the Illinois Environmental Protection Agency a copy of the |
| 13 | | information the Agency collects from the recycler in order to |
| 14 | | conduct the prior experience evaluation required under Senate |
| 15 | | Bill 1925, if that bill is enacted into law; and be it further
|
| 16 | | RESOLVED, That we urge the Department to obtain |
| 17 | | verification from the recycler as to the accuracy and |
| 18 | | sufficiency of the information in the Beneficial Use |
| 19 | | Determination; and be it further |
| 20 | | RESOLVED, That we urge the Department to review all |
| 21 | | verified information from the Illinois Environmental |
| 22 | | Protection Agency and the recycler in order to make a |
| 23 | | determination regarding the propriety of the recycler's |

| 1 | | production of material for use in hot mix asphalt projects; and |
| 2 | | we further urge the Department not to approve any recycler that |
| 3 | | has a pending or unresolved environmental compliance action in |
| 4 | | this State or any other against it or any of its principals; |
| 5 | | and be it further |
| 6 | | RESOLVED, That we urge the Department, on an annual basis, |
| 7 | | to obtain verification, for each hot mix asphalt plant that |
| 8 | | used recycled asphalt shingles on Department projects during |
| 9 | | the previous calendar year, of the number of tons of recycled |
| 10 | | asphalt shingles used in Department contracts (by contract) and |
| 11 | | that the usage was in accordance with subsection (b) of Section |
| 12 | | 4-221 of the Illinois Highway Code; and we further urge the |
| 13 | | Department not to approve a hot mix asphalt plant for |
| 14 | | production in any calendar year prior to receiving that |
| 15 | | verification.
