| 1 | | AN ACT concerning local government.
|
| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:
|
| 4 | | Section 5. The Environmental Protection Act is amended by |
| 5 | | changing Section 17.9A as follows: |
| 6 | | (415 ILCS 5/17.9A) |
| 7 | | Sec. 17.9A. Collection, storage, and transportation of |
| 8 | | pharmaceuticals by law enforcement agencies. |
| 9 | | (a) Notwithstanding any other provision of this Act, to the |
| 10 | | extent allowed by federal law, a law enforcement agency may |
| 11 | | collect pharmaceuticals, including but not limited to |
| 12 | | controlled substances, from residential sources, store them, |
| 13 | | and transport them to a site or facility an incinerator |
| 14 | | permitted by the Agency to be incinerated in accordance with |
| 15 | | the permit, permit conditions, this Act, and rules adopted |
| 16 | | under this Act. |
| 17 | | (b) Pharmaceuticals that have been transported to a |
| 18 | | permitted site or facility by a law enforcement agency under |
| 19 | | subsection (a) of this Section must be managed in accordance |
| 20 | | with this Act, rules adopted under this Act, and permits issued |
| 21 | | under this Act. If those pharmaceuticals are controlled |
| 22 | | substances, they must also be managed in accordance with |
| 23 | | federal and State laws and regulations governing controlled |
