| 2 | | AMENDMENT NO. ______. Amend Senate Bill 2797 as follows:

| 3 | | on page 6, immediately below line 11, by inserting the |
| 4 | | following: |
| 5 | | "(d) Nothing contained in this Section shall operate to |
| 6 | | render a use agreement or precursor placement agreement in |
| 7 | | connection with a use agreement void or voidable if such an |
| 8 | | agreement was entered into and assigned prior to the effective |
| 9 | | date of this amendatory Act of the 98th General Assembly, |
| 10 | | provided that payment for the use agreement or precursor |
| 11 | | placement agreement shall not be based on a percentage of video |
| 12 | | gaming revenues.".
