| 1 | AN ACT concerning transportation.

| 2 | Be it enacted by the People of the State of Illinois,
| ||||||
| 3 | represented in the General Assembly:
| ||||||
| 4 | Section 5. The Illinois Vehicle Code is amended by changing | ||||||
| 5 | Sections 11-709.2 and 11-709.3 as follows: | ||||||
| 6 | (625 ILCS 5/11-709.2) | ||||||
| 7 | Sec. 11-709.2. Bus on shoulder pilot program. | ||||||
| 8 | (a) The For purposes of this Section, "bus on shoulders" is | ||||||
| 9 | the use of specifically designated shoulders of roadways by | ||||||
| 10 | authorized transit buses may be authorized by . The shoulders | ||||||
| 11 | may be used by transit buses at times and locations as set by | ||||||
| 12 | the Department in cooperation with the Regional Transportation | ||||||
| 13 | Authority and the Suburban Bus Division of the Regional | ||||||
| 14 | Transportation Authority. The Department shall prescribe by | ||||||
| 15 | rule which transit buses are authorized to operate on | ||||||
| 16 | shoulders, as well as times and locations. The Department may | ||||||
| 17 | erect signage to indicate times and locations of designated | ||||||
| 18 | shoulder usage. | ||||||
| 19 | (b) (Blank) Commencing on the effective date of this | ||||||
| 20 | amendatory Act of the 97th General Assembly, the Department | ||||||
| 21 | along with the Regional Transportation Authority and Suburban | ||||||
| 22 | Bus Division of the Regional Transportation Authority in | ||||||
| 23 | cooperation with the Illinois State Police shall establish a | ||||||

| 1 | 5-year pilot program within the boundaries of the Regional | ||||||
| 2 | Transportation Authority for transit buses on highways and | ||||||
| 3 | shoulders. The pilot program may be implemented on shoulders of | ||||||
| 4 | highways as designated by the Department in cooperation with | ||||||
| 5 | the Regional Transportation Authority and Suburban Bus | ||||||
| 6 | Division of the Regional Transportation Authority. The | ||||||
| 7 | Department may adopt rules necessary for transit buses to use | ||||||
| 8 | roadway shoulders. | ||||||
| 9 | (c) (Blank) After the pilot program established under | ||||||
| 10 | subsection (b) of this Section has been operating for 2 years, | ||||||
| 11 | the Department in cooperation with the Regional Transit | ||||||
| 12 | Authority, the Suburban Bus Division of the Regional | ||||||
| 13 | Transportation Authority, and the Illinois State Police shall | ||||||
| 14 | issue a report to the General Assembly on the effectiveness of | ||||||
| 15 | the bus on shoulders pilot program.
