| 1 | | AN ACT concerning criminal law.
|
| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:
|
| 4 | | Section 1. Short title. This Act may be cited as the Kratom |
| 5 | | Control Act.
|
| 6 | | Section 5. Kratom sale to or possession by minors |
| 7 | | prohibited. |
| 8 | | (a) As used in this Act, "Kratom" means any parts of the |
| 9 | | plant Mitragyna
speciosa, whether growing or not, and any |
| 10 | | compound, manufacture, salt, derivative,
mixture, or |
| 11 | | preparation of that plant, including but not limited to |
| 12 | | mitragynine and 7-hydroxymitragynine. |
| 13 | | (b) A minor under 18 years of age shall not knowingly |
| 14 | | purchase or possess any product containing any
quantity of |
| 15 | | Kratom. |
| 16 | | (c) A minor under 18 years of age in the furtherance or |
| 17 | | facilitation of obtaining any product
containing Kratom shall |
| 18 | | not knowingly display or use a false or forged identification |
| 19 | | card or transfer,
alter, or deface an identification card. |
| 20 | | (d) A person shall not knowingly sell, buy for, distribute |
| 21 | | samples of, or furnish any product containing any
quantity of |
| 22 | | Kratom to any minor under 18 years of age. |
| 23 | | (e) Sentence. Violation of subsection (b) or (c) of this |
