AMENDMENT TO HOUSE BILL 4899 




2    AMENDMENT NO. ______. Amend House Bill 4899 by replacing 
3everything after the enacting clause with the following:

 
4    "Section 5. The Director of the Department of Natural 
5Resources, on behalf of the State of Illinois, is authorized to 
6execute and deliver to Sangamon County, an Illinois unit of 
7local government, State of Illinois, for and in consideration 
8of $1 paid to the Department, a quit claim deed to the 
9following described real property:
10    All that portion of the right of way and appurtenances of

11    the abandoned portion of the Madison Subdivision of Union

12    Pacific Railroad Company (formerly the Chicago and North

13    Western Transportation Company), now known as the Sangamon

14    Valley Trail Bikeway, described as Beginning at the North

15    line of Township 12 North, Range 6 West of the Third

16    Principal Meridian, and thence running in a northerly

17    direction along the centerline of said abandoned railroad

1    to the North line of Section 19, Township 17 North, Range 5

2    West of the Third Principal Meridian, and also that portion

3    of the said abandoned railroad within the County of

4    Sangamon in Sections 6 and 7, Township 17 North, Range 5

5    West of the Third Principal Meridian and Section 31,

6    Township 18 North, Range 5 West of the Third Principal

7    Meridian as measured along said centerline of said

8    abandoned railroad as originally surveyed, all being

9    situated in the County of Sangamon and the State of

10    Illinois. EXCEPTING THEREFROM: All that portion of the

11    right of way and appurtenances of the abandoned portion of

12    the Madison Subdivision of Union Pacific Railroad Company

13    (formerly the Chicago and North Western Transportation

14    Company), now known as the Sangamon Valley Trail Bikeway,

15    described as Beginning at the South line of Section 10,

16    Township 15 North, Range 6 West of the Third Principal

17    Meridian, and thence running in a northerly direction along

18    the centerline of said abandoned railroad to a line being

19    parallel to and 200 feet North of the North line of the

20    Southwest Quarter of Section 19, Township 16 North, Range 5

21    West of the Third Principal Meridian, as measured along

22    said centerline of said abandoned railroad as originally

23    surveyed, all being situated in the County of Sangamon and

24    the State of Illinois.
 
25    Section 10. The conveyance of real property authorized by

1Section 5 shall be made subject to:  (1) existing public 
2utilities, existing public roads, and any and all reservations, 
3easements, encumbrances, covenants and restrictions of record; 
4and (2) the express condition that if the real property ceases 
5to be used for public purposes, it shall revert to the State of 
6Illinois, Department of Natural Resources.
 
7    Section 15. The Director of Natural Resources shall obtain 
8a
certified copy of the portions of this Act containing the 
9title,
the enacting clause, the effective date, the appropriate 
10Section
or Sections containing the land descriptions of the 
11property to
be conveyed, and this Section within 60 days after 
12its effective
date and, upon receipt of the payment required by 
13the Section or
Sections, if any payment is required, shall 
14record the certified
document in the Recorder's Office in the 
15County in which the
land is located.

 

16    Section 99. Effective date. This Act takes effect upon 
17becoming law.".
