1    AN ACT concerning State government.

 
2    Be it enacted by the People of the State of Illinois, 
3represented in the General Assembly: 



 
4    Section 5. The Director of the Department of Natural 
5Resources, on behalf of the State of Illinois, is authorized to 
6execute and deliver to Sangamon County, an Illinois unit of 
7local government, State of Illinois, for and in consideration 
8of $1 paid to the Department, a quit claim deed to the 
9following described real property:
10    All that portion of the right of way and appurtenances of

11    the abandoned portion of the Madison Subdivision of Union

12    Pacific Railroad Company (formerly the Chicago and North

13    Western Transportation Company), now known as the Sangamon

14    Valley Trail Bikeway, described as Beginning at the North

15    line of Township 12 North, Range 6 West of the Third

16    Principal Meridian, and thence running in a northerly

17    direction along the centerline of said abandoned railroad

18    to the North line of Section 19, Township 17 North, Range 5

19    West of the Third Principal Meridian, and also that portion

20    of the said abandoned railroad within the County of

21    Sangamon in Sections 6 and 7, Township 17 North, Range 5

22    West of the Third Principal Meridian and Section 31,

23    Township 18 North, Range 5 West of the Third Principal

24    Meridian as measured along said centerline of said

1    abandoned railroad as originally surveyed, all being

2    situated in the County of Sangamon and the State of

3    Illinois. EXCEPTING THEREFROM: All that portion of the

4    right of way and appurtenances of the abandoned portion of

5    the Madison Subdivision of Union Pacific Railroad Company

6    (formerly the Chicago and North Western Transportation

7    Company), now known as the Sangamon Valley Trail Bikeway,

8    described as Beginning at the South line of Section 10,

9    Township 15 North, Range 6 West of the Third Principal

10    Meridian, and thence running in a northerly direction along

11    the centerline of said abandoned railroad to a line being

12    parallel to and 200 feet North of the North line of the

13    Southwest Quarter of Section 19, Township 16 North, Range 5

14    West of the Third Principal Meridian, as measured along

15    said centerline of said abandoned railroad as originally

16    surveyed, all being situated in the County of Sangamon and

17    the State of Illinois.
 
18    Section 10. The conveyance of real property authorized by 
19Section 5 shall be made subject to:  (1) existing public 
20utilities, existing public roads, and any and all reservations, 
21easements, encumbrances, covenants and restrictions of record; 
22and (2) the express condition that if the real property ceases 
23to be used for public purposes, it shall revert to the State of 
24Illinois, Department of Natural Resources.

1    Section 15. The Director of Natural Resources shall obtain 
2a
certified copy of the portions of this Act containing the 
3title,
the enacting clause, the effective date, the appropriate 
4Section
or Sections containing the land descriptions of the 
5property to
be conveyed, and this Section within 60 days after 
6its effective
date and, upon receipt of the payment required by 
7the Section or
Sections, if any payment is required, shall 
8record the certified
document in the Recorder's Office in the 
9County in which the
land is located.

 

10    Section 99. Effective date. This Act takes effect upon 
11becoming law.
