| 1 | | AN ACT concerning State government.
|
| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:
|
| 4 | | Section 5. The Department of Professional Regulation Law of |
| 5 | | the
Civil Administrative Code of Illinois is amended by adding |
| 6 | | Section 2105-17 as follows: |
| 7 | | (20 ILCS 2105/2105-17 new) |
| 8 | | Sec. 2105-17. Volunteer licenses. |
| 9 | | (a) For the purposes of this Section: |
| 10 | | "Health care professional" means a physician licensed |
| 11 | | under the Medical Practice Act of 1987, a dentist licensed |
| 12 | | under the Illinois Dental Practice Act, an optometrist licensed |
| 13 | | under the Illinois Optometric Practice Act of 1987, a physician |
| 14 | | assistant licensed under the Physician Assistant Practice Act |
| 15 | | of 1987, and a nurse or advanced practice nurse licensed under |
| 16 | | the Nurse Practice Act. The Department may expand this |
| 17 | | definition by rule. |
| 18 | | "Volunteer practice" means the practice of a licensed |
| 19 | | health care professional for the benefit of an individual or |
| 20 | | the public and without compensation for the health care |
| 21 | | services provided. |
| 22 | | (b) The Department may grant a volunteer license to a |
| 23 | | health care professional who: |

| 1 | | (1) meets all requirements of the State licensing Act |
| 2 | | that applies to his or her health care profession and the |
| 3 | | rules adopted under the Act; and |
| 4 | | (2) agrees to engage in the volunteer practice of his |
| 5 | | or her health care profession in a free medical clinic, as |
| 6 | | defined in the Good Samaritan Act, or in a public health |
| 7 | | clinic, as defined in Section 6-101 of the Local |
| 8 | | Governmental and Governmental Employees Tort Immunities |
| 9 | | Act, and to not practice for compensation. |
| 10 | | (c) A volunteer license shall be granted in accordance with |
| 11 | | the licensing Act that applies to the health care |
| 12 | | professional's given health care profession, and the licensure |
| 13 | | fee shall be set by rule in accordance with subsection (f). |
| 14 | | (d) No health care professional shall hold a non-volunteer |
| 15 | | license in a health care profession and a volunteer license in |
| 16 | | that profession at the same time. In the event that the health |
| 17 | | care professional obtains a volunteer license in the profession |
| 18 | | for which he or she holds a non-volunteer license, that |
| 19 | | non-volunteer license shall automatically be placed in |
| 20 | | inactive status. In the event that a health care professional |
| 21 | | obtains a non-volunteer license in the profession for which he |
| 22 | | or she holds a volunteer license, the volunteer license shall |
| 23 | | be placed in inactive status. Practicing on an expired |
| 24 | | volunteer license constitutes the unlicensed practice of the |
| 25 | | health care professional's profession. |
| 26 | | (e) Nothing in this Section shall be construed to waive or |

| 1 | | modify any statute, rule, or regulation concerning the |
| 2 | | licensure or practice of any health care profession. A health |
| 3 | | care professional who holds a volunteer license shall be |
| 4 | | subject to all statutes, rules, and regulations governing his |
| 5 | | or her profession. The Department shall waive the licensure fee |
| 6 | | for the first 500 volunteer licenses issued and may by rule |
| 7 | | provide for a fee waiver or fee reduction that shall apply to |
| 8 | | all licenses issued after the initial 500. |
| 9 | | (f) The Department shall determine by rule the total number |
| 10 | | of volunteer licenses to be issued. The Department shall file |
| 11 | | proposed rules implementing this Section within 6 months after |
| 12 | | the effective date of this amendatory Act of the 98th General |
| 13 | | Assembly.

| 14 | | Section 99. Effective date. This Act takes effect upon |
| 15 | | becoming law.
