| 1 | | AN ACT concerning local government.

| 2 | | Be it enacted by the People of the State of Illinois,

| 3 | | represented in the General Assembly:

| 4 | | Section 5. The Illinois Municipal Code is amended by adding |
| 5 | | Section 11-55-3 as follows:
|
| 6 | | (65 ILCS 5/11-55-3 new) |
| 7 | | Sec. 11-55-3. As used in this Division, "vending machine" |
| 8 | | means a coin, currency, or debit card operated machine that |
| 9 | | dispenses goods or services, and includes machines that use |
| 10 | | utility services. "Vending machine" includes those machines |
| 11 | | that provide an enclosed space or area for the use of a |
| 12 | | customer or for the delivery of the goods or services. "Vending |
| 13 | | machine" does not include machines operated by the United |
| 14 | | States Postal Service for the sale of postage stamps or other |
| 15 | | postal products and services, or machines described in Section |
| 16 | | 1 of the Coin-Operated Amusement Device and Redemption Machine |
| 17 | | Tax Act.
