Amends the Employment of Teachers Article of the School Code. Makes changes to a Section concerning physical fitness and professional growth. Defines "employee". Removes a requirement that new employees provide evidence of freedom from tuberculosis. Provides instead that a new or existing employee may be subject to additional health examinations, including screening for tuberculosis, as required by rules adopted by the Department of Public Health or by order of a local public health official. Provides that school boards may require employees (instead of teachers in their employ) to furnish evidence of continued professional growth. Effective immediately.

| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:
|
| 4 | | Section 5. The School Code is amended by changing Section |
| 5 | | 24-5 as follows:
|
| 6 | | (105 ILCS 5/24-5) (from Ch. 122, par. 24-5)

| 7 | | Sec. 24-5. Physical fitness and professional growth. |
| 8 | | (a) In this Section, "employee" means any employee of a |
| 9 | | school district, a student teacher, an employee of a contractor |
| 10 | | that provides services to students or in schools, or any other |
| 11 | | individual subject to the requirements of Section 10-21.9 or |
| 12 | | 34-18.5 of this Code. |
| 13 | | (b) School boards shall require of new employees evidence |
| 14 | | of physical
fitness to perform duties assigned and freedom from |
| 15 | | communicable disease,
including tuberculosis. Such evidence |
| 16 | | shall consist of a physical
examination and a tuberculin skin |
| 17 | | test and, if appropriate, an x-ray, made
by a physician |
| 18 | | licensed in Illinois or any other state to practice medicine
|
| 19 | | and surgery in all its branches, an advanced practice nurse who |
| 20 | | has a written collaborative agreement with a collaborating |
| 21 | | physician that authorizes the advanced practice nurse to |
| 22 | | perform health examinations, or a physician assistant who has |
| 23 | | been delegated the authority to perform health examinations by |
