AMENDMENT TO HOUSE BILL 3944

AMENDMENT NO. ______. Amend House Bill 3944, AS AMENDED, by replacing everything after the enacting clause with the following:

"Section 5. The Board of Higher Education Act is amended by adding Section 8.5 as follows:

(110 ILCS 205/8.5 new)

Sec. 8.5. Capital appropriation; facility renovations at universities.

(a) With regard to a capital appropriation made on or after the effective date of this amendatory Act of the 98th General Assembly for new construction only, up to 10% of that appropriation may, at the request of a public university's board of trustees, be set aside in a separate fund held locally by the university for use in addressing capital renewal or deferred maintenance needs as they arise.

(b) The Board shall allow public universities to recalculate project requests for prioritization if they elect to utilize the capital renewal set-aside provided for in this Section.

Section 99. Effective date. This Act takes effect July 1, 2014.".
