AMENDMENT TO HOUSE BILL 3319




2    AMENDMENT NO. ______. Amend House Bill 3319, AS AMENDED, 
3with reference to page and line numbers of House Amendment No. 
41, as follows:


 
5on page 10, in line 6, by replacing "dry, uncontaminated," with 
6"uncontaminated"; and
 
7on page 10, in line 7, immediately after "source separated" by 
8inserting "(i)"; and
 
9on page 10, in line 11, immediately after "roots", by inserting 
10"and (ii) plant-derived animal bedding, such as straw or 
11sawdust, that is free of manure and was not made from painted 
12or treated wood"; and
 
13by replacing line 24, on page 11, through line 2, on page 12, 
14with the following:

1    "the same property as the facility) or a lesser distance 
2    from the nearest residence (other than a residence located 
3    on the same property as the facility) if the municipality 
4    or county in which the facility is located has by ordinance 
5    approved a lesser distance than 1/4 mile and there are not 
6    more than 10 occupied non-farm residences within 1/2 mile 
7    of the boundaries of the site on the date of the 
8    application, and was placed more than 5 feet above the 
9    water table. Any ordinance approving a residential setback 
10    of less than 1/4 mile that is used to meet the requirements 
11    of this subparagraph (D) must specifically reference this 
12    subparagraph.".
