AMENDMENT TO HOUSE BILL 3061 




2    AMENDMENT NO. ______. Amend House Bill 3061 on page 16, 
3immediately below line 22, by inserting the following:


4        "Possession with intent to manufacture or deliver a 
5    controlled substance under Section 401 of the Illinois 
6    Controlled Substances Act."; and
 
7on page 17, line 1, by replacing "Offenses" with "Possession 
8with intent to manufacture or deliver a controlled substance"; 
9and
 
10on page 22, line 1, by inserting after "hearing." the 
11following:
12"The court may consider the following:
13            (A) the strength of the evidence supporting the 
14        defendant's conviction; 
15            (B) the reasons for retention of the conviction 
16        records by the State;

1            (C) the petitioner's age, criminal record history, 
2        and employment history; 
3            (D) the period of time between the petitioner's 
4        arrest on the charge resulting in the conviction and 
5        the filing of the petition under this Section; and 
6            (E) the specific adverse consequences the 
7        petitioner may be subject to if the petition is 
8        denied.".
