| 1 | | AN ACT concerning public aid.
|
| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:
|
| 4 | | Section 5. The Illinois Public Aid Code is amended by |
| 5 | | adding Section 12-4.45 as follows:
|
| 6 | | (305 ILCS 5/12-4.45 new) |
| 7 | | Sec. 12-4.45. Change in legal guardianship; notification. |
| 8 | | Whenever there is a change in legal guardianship of a minor |
| 9 | | child who receives benefits under this Code, the appropriate |
| 10 | | State agency shall immediately inform the Department of Human |
| 11 | | Services of the change in legal guardianship to ensure such |
| 12 | | benefits are sent directly to the minor child's legal guardian. |
| 13 | | For purposes of this Section, "legal guardian" means a |
| 14 | | person appointed guardian, or given custody, of a minor by a |
| 15 | | circuit court of the State, but does not include a person |
| 16 | | appointed guardian, or given custody, of a minor under the |
| 17 | | Juvenile Court Act or the Juvenile Court Act of 1987.

| 18 | | Section 99. Effective date. This Act takes effect upon |
| 19 | | becoming law.
