| 1 | | AN ACT concerning finance.
|
| 2 | | Be it enacted by the People of the State of Illinois, |
| 3 | | represented in the General Assembly:
|
| 4 | | Section 5. The State Finance Act is amended by adding |
| 5 | | Section 5i as follows:
|
| 6 | | (30 ILCS 105/5i new) |
| 7 | | Sec. 5i. Closure of State mental health facilities. |
| 8 | | Consistent with the provisions of Sections 4.4 and 4.5 of the |
| 9 | | Community Services Act, whenever a State mental health facility |
| 10 | | operated by the Department of Human Services is closed, the |
| 11 | | Department of Human Services, at the direction of the Governor, |
| 12 | | shall transfer funds from the closed facility to the |
| 13 | | appropriate line item providing appropriation authority for |
| 14 | | the new venue of care to facilitate the transition of services |
| 15 | | to the new venue of care, provided that the new venue of care |
| 16 | | is a Department of Human Services funded provider or facility. |
| 17 | | As used in this Section, the term "mental health facility" |
| 18 | | has the meaning ascribed to that term in the Mental Health and |
| 19 | | Developmental Disabilities Code.
