| 1 | | AN ACT concerning local government.
|
| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:

| 4 | | Section 5. The Illinois Municipal Code is amended by adding |
| 5 | | Section 11-42-15 as follows:
|
| 6 | | (65 ILCS 5/11-42-15 new) |
| 7 | | Sec. 11-42-15. Wind energy systems. For electric |
| 8 | | generating wind devices other than those with a nameplate |
| 9 | | generating capacity of less than 100 kilowatts that are used |
| 10 | | primarily by an end user, a municipality may prohibit any |
| 11 | | electric generating wind device from locating within its |
| 12 | | corporate limits, provided that the regulation is not |
| 13 | | inconsistent with another municipality's zoning regulation. |
| 14 | | This Section shall apply only to electric generating wind |
| 15 | | devices permitted after the effective date of this amendatory |
| 16 | | Act of the 98th General Assembly.

| 17 | | Section 99. Effective date. This Act takes effect upon |
| 18 | | becoming law.
