SYNOPSIS AS INTRODUCED:

Amends various Acts relating to the governance of State universities. With respect to any contract or collective bargaining agreement entered into, amended, or renewed on or after the effective date of the amendatory Act, provides that a university is prohibited from entering into a contract or agreement that offers its employees or contractors tuition waivers, grants, scholarships, or any other higher education benefits for the children, spouses, or other family members of the employees or contractors. Provides that nothing in this prohibition prevents or diminishes the right of a child, spouse, or other family member of an employee or contractor to borrow money for higher education expenses or apply for and be awarded a tuition waiver, grant, scholarship, or other award for higher education expenses, provided that there is no conflict of interest and no preference is given on account of the person being the child, spouse, or other family member of an employee or contractor. Provides that nothing in this prohibition shall diminish the value of contractual rights existing before the effective date of the amendatory Act that are enjoyed by employees and contractors of the university or their children, spouses, and other family members. Repeals provisions that permit the children of employees of a State university who have been employed by any one or by more than one State university for an aggregate period of at least 7 years to receive a 50% tuition waiver. Effective immediately.

AN ACT concerning higher education.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The University of Illinois Act is amended by adding Section 85 as follows:

(110 ILCS 305/85 new)

Sec. 85. Employee educational benefits prohibited.

(a) This Section applies to any contract or collective bargaining agreement entered into, amended, or renewed on or after the effective date of this amendatory Act of the 98th General Assembly.

(b) The University is prohibited from entering into any contract or agreement that offers its employees or contractors tuition waivers, grants, scholarships, or any other higher education benefits for the children, spouses, or other family members of the employees or contractors.

(c) Nothing in this Section prevents or diminishes the right of a child, spouse, or other family member of an employee or contractor to borrow money for higher education expenses or apply for and be awarded a tuition waiver, grant, scholarship, or other award for higher education expenses, provided that there is no conflict of interest and no preference is given on account of the person being the child, spouse, or other family member of an employee or contractor.

(d) Nothing in this Section shall diminish the value of contractual rights existing before the effective date of this amendatory Act of the 98th General Assembly that are enjoyed by employees and contractors of the University or their children, spouses, and other family members.

Section 10. The Southern Illinois University Management Act is amended by adding Section 70 as follows:

Sec. 70. Employee educational benefits prohibited.

(a) This Section applies to any contract or collective bargaining agreement entered into, amended, or renewed on or after the effective date of this amendatory Act of the 98th General Assembly.

(b) The University is prohibited from entering into any contract or agreement that offers its employees or contractors tuition waivers, grants, scholarships, or any other higher education benefits for the children, spouses, or other family members of the employees or contractors.

(c) Nothing in this Section prevents or diminishes the right of a child, spouse, or other family member of an employee or contractor to borrow money for higher education expenses or apply for and be awarded a tuition waiver, grant, scholarship, or other award for higher education expenses, provided that there is no conflict of interest and no preference is given on account of the person being the child, spouse, or other family member of an employee or contractor.

(d) Nothing in this Section shall diminish the value of contractual rights existing before the effective date of this amendatory Act of the 98th General Assembly that are enjoyed by employees and contractors of the University or their children, spouses, and other family members.

Section 15. The Chicago State University Law is amended by adding Section 5-180 as follows:

Sec. 5-180. Employee educational benefits prohibited.

(a) This Section applies to any contract or collective bargaining agreement entered into, amended, or renewed on or after the effective date of this amendatory Act of the 98th General Assembly.

(b) The University is prohibited from entering into any contract or agreement that offers its employees or contractors tuition waivers, grants, scholarships, or any other higher education benefits for the children, spouses, or other family members of the employees or contractors.

(c) Nothing in this Section prevents or diminishes the right of a child, spouse, or other family member of an employee or contractor to borrow money for higher education expenses or apply for and be awarded a tuition waiver, grant, scholarship, or other award for higher education expenses, provided that there is no conflict of interest and no preference is given on account of the person being the child, spouse, or other family member of an employee or contractor.

Section 20. The Eastern Illinois University Law is amended by adding Section 10-180 as follows:

(a) This Section applies to any contract or collective bargaining agreement entered into, amended, or renewed on or after the effective date of this amendatory Act of the 98th General Assembly.

(b) The University is prohibited from entering into any contract or agreement that offers its employees or contractors tuition waivers, grants, scholarships, or any other higher education benefits for the children, spouses, or other family members of the employees or contractors.

(c) Nothing in this Section prevents or diminishes the right of a child, spouse, or other family member of an employee or contractor to borrow money for higher education expenses or apply for and be awarded a tuition waiver, grant, scholarship, or other award for higher education expenses, provided that there is no conflict of interest and no preference is given on account of the person being the child, spouse, or other family member of an employee or contractor.

Section 25. The Governors State University Law is amended by adding Section 15-180 as follows:

(a) This Section applies to any contract or collective bargaining agreement entered into, amended, or renewed on or after the effective date of this amendatory Act of the 98th General Assembly.

(b) The University is prohibited from entering into any contract or agreement that offers its employees or contractors tuition waivers, grants, scholarships, or any other higher education benefits for the children, spouses, or other family members of the employees or contractors.

(c) Nothing in this Section prevents or diminishes the right of a child, spouse, or other family member of an employee or contractor to borrow money for higher education expenses or apply for and be awarded a tuition waiver, grant, scholarship, or other award for higher education expenses, provided that there is no conflict of interest and no preference is given on account of the person being the child, spouse, or other family member of an employee or contractor.

Section 30. The Illinois State University Law is amended by adding Section 20-185 as follows:

(a) This Section applies to any contract or collective bargaining agreement entered into, amended, or renewed on or after the effective date of this amendatory Act of the 98th General Assembly.

(b) The University is prohibited from entering into any contract or agreement that offers its employees or contractors tuition waivers, grants, scholarships, or any other higher education benefits for the children, spouses, or other family members of the employees or contractors.

(c) Nothing in this Section prevents or diminishes the right of a child, spouse, or other family member of an employee or contractor to borrow money for higher education expenses or apply for and be awarded a tuition waiver, grant, scholarship, or other award for higher education expenses, provided that there is no conflict of interest and no preference is given on account of the person being the child, spouse, or other family member of an employee or contractor.

Section 35. The Northeastern Illinois University Law is amended by adding Section 25-180 as follows:

(a) This Section applies to any contract or collective bargaining agreement entered into, amended, or renewed on or after the effective date of this amendatory Act of the 98th General Assembly.

(b) The University is prohibited from entering into any contract or agreement that offers its employees or contractors tuition waivers, grants, scholarships, or any other higher education benefits for the children, spouses, or other family members of the employees or contractors.

(c) Nothing in this Section prevents or diminishes the right of a child, spouse, or other family member of an employee or contractor to borrow money for higher education expenses or apply for and be awarded a tuition waiver, grant, scholarship, or other award for higher education expenses, provided that there is no conflict of interest and no preference is given on account of the person being the child, spouse, or other family member of an employee or contractor.

Section 40. The Northern Illinois University Law is amended by adding Section 30-190 as follows:

Sec. 30-190. Employee educational benefits prohibited.

(a) This Section applies to any contract or collective bargaining agreement entered into, amended, or renewed on or after the effective date of this amendatory Act of the 98th General Assembly.

(b) The University is prohibited from entering into any contract or agreement that offers its employees or contractors tuition waivers, grants, scholarships, or any other higher education benefits for the children, spouses, or other family members of the employees or contractors.

(c) Nothing in this Section prevents or diminishes the right of a child, spouse, or other family member of an employee or contractor to borrow money for higher education expenses or apply for and be awarded a tuition waiver, grant, scholarship, or other award for higher education expenses, provided that there is no conflict of interest and no preference is given on account of the person being the child, spouse, or other family member of an employee or contractor.

Section 45. The Western Illinois University Law is amended by adding Section 35-185 as follows:

Sec. 35-185. Employee educational benefits prohibited.

(a) This Section applies to any contract or collective bargaining agreement entered into, amended, or renewed on or after the effective date of this amendatory Act of the 98th General Assembly.

(b) The University is prohibited from entering into any contract or agreement that offers its employees or contractors tuition waivers, grants, scholarships, or any other higher education benefits for the children, spouses, or other family members of the employees or contractors.

(c) Nothing in this Section prevents or diminishes the right of a child, spouse, or other family member of an employee or contractor to borrow money for higher education expenses or apply for and be awarded a tuition waiver, grant, scholarship, or other award for higher education expenses, provided that there is no conflict of interest and no preference is given on account of the person being the child, spouse, or other family member of an employee or contractor.
