AMENDMENT TO HOUSE BILL 140

AMENDMENT NO. ______. Amend House Bill 140 by replacing everything after the enacting clause with the following:

"Section 5. The State Employees Group Insurance Act of 1971 is amended by adding Sections 2.5, 2.6, 2.7, and 2.8 as follows:

(5 ILCS 375/2.5 new)

Sec. 2.5. Application to Regional Transportation Authority Board members. Notwithstanding any other provision of this Act to the contrary, this Act does not apply to any member of the Regional Transportation Authority Board with respect to service on that Board during a term of office that begins on or after the effective date of this amendatory Act of the 98th General Assembly.

(5 ILCS 375/2.6 new)

Sec. 2.6. Application to Suburban Bus Board members. Notwithstanding any other provision of this Act to the contrary, this Act does not apply to any member of the Suburban Bus Board with respect to service on that Board during a term of office that begins on or after the effective date of this amendatory Act of the 98th General Assembly.

Sec. 2.7. Application to Commuter Rail Board members. Notwithstanding any other provision of this Act to the contrary, this Act does not apply to any member of the Commuter Rail Board with respect to service on that Board during a term of office that begins on or after the effective date of this amendatory Act of the 98th General Assembly.

Notwithstanding any other provision of this Act to the contrary, this Act does not apply to any member of the Chicago Transit Authority Board with respect to service on that Board during a term of office that begins on or after the effective date of this amendatory Act of the 98th General Assembly.

Section 10. The Illinois Pension Code is amended by adding Sections 22-105, 22-106, 22-107, and 22-108 as follows:

(40 ILCS 5/22-105 new)

Sec. 22-105. Application to Regional Transportation Authority Board members. This Code does not apply to any individual who first becomes a member of the Regional Transportation Authority Board on or after the effective date of this amendatory Act of the 98th General Assembly with respect to service on that Board.

(40 ILCS 5/22-106 new)

Sec. 22-106. Application to Suburban Bus Board members. This Code does not apply to any individual who first becomes a member of the Suburban Bus Board on or after the effective date of this amendatory Act of the 98th General Assembly with respect to service on that Board.

(40 ILCS 5/22-107 new)

Sec. 22-107. Application to Commuter Rail Board members. This Code does not apply to any individual who first becomes a member of the Commuter Rail Board on or after the effective date of this amendatory Act of the 98th General Assembly with respect to service on that Board.

(40 ILCS 5/22-108 new)

Sec. 22-108. Application to Chicago Transit Authority Board members. This Code does not apply to any individual who first becomes a member of the Chicago Transit Authority Board on or after the effective date of this amendatory Act of the 98th General Assembly with respect to service on that Board.

Section 15. The Metropolitan Transit Authority Act is amended by changing Sections 19 and 22 as follows:

Sec. 19. Compensation; pension; benefits.

(a) The governing and administrative body of the Authority shall be a board consisting of seven members, to be known as Chicago Transit Board. Members of the Board shall be residents of the metropolitan area and persons of recognized business ability. No member of the Board of the Authority shall hold any other office or employment under the Federal, State or any County or any municipal government except an honorary office without compensation or an office in the National Guard. No employee of the Authority shall hold any other office or employment under the Federal, State or any County or any municipal government except an office with compensation not exceeding $15,000 annually or a position in the National Guard or the United States military reserves. Provided, however, that the Chairman may be a member of the Board of the Regional Transportation Authority. No member of the Board or employee of the Authority shall have any private financial interest, profit or benefit in any contract, work or business of the Authority nor in the sale or lease of any property to or from the Authority.

(b) The provisions of this subsection (b) apply only for terms of office beginning before the effective date of this amendatory Act of the 98th General Assembly. The salary of each member of the initial Board shall be $15,000.00 per annum, and such salary shall not be increased or diminished during his or her term of office. The salaries of successor members of the Board shall be fixed by the Board and shall not be increased or diminished during their respective terms of office. No Board member shall be allowed any fees, perquisites or emoluments, reward or compensation for his or her services as a member or officer of the Authority aside from his or her salary or pension, but he or she shall be reimbursed for actual expenses incurred by him or her in the performance of his or her duties.

(c) For terms of office beginning on or after the effective date of this amendatory Act of the 98th General Assembly, each member of the Board shall be compensated $500 for attendance at each meeting of the Board and each other meeting he or she is statutorily required to attend in his or her capacity as a member of the Board, and for actual expenses incurred in travel to and from those meetings, but he or she shall not be otherwise compensated for service as a member of the Board.

For individuals who first become members of the Board on or after the effective date of this amendatory Act of the 98th General Assembly, no service or contribution shall be credited in any retirement system or pension fund, under the Illinois Pension Code or otherwise, for service on the Board, and no public funds shall be appropriated, expended, or otherwise obligated for such a retirement system or pension fund credit. For terms of office beginning on or after the effective date of this amendatory Act of the 98th General Assembly, neither the chairperson nor any other member of the Board shall be entitled to participate in a program of life or health insurance as a consequence of his or her service on the Board.

Sec. 22. Chairperson; terms; compensation. As soon as possible after the appointment of the initial members, the board shall organize for the transaction of business, select a chairman and a temporary secretary from its own number, and adopt by-laws, rules and regulations to govern its proceedings. The initial chairman and successors shall be elected by the Board from time to time for the term of his or her office as a member of the Board or for the term of three years, whichever is shorter.

The Board shall fix the salary of the chairperson chairman in addition to his salary as a member of the Board, which shall not be increased or diminished during his or her term of office as chairperson chairman. But if the chairperson chairman is engaged in any other business or employment during his or her term as chairperson chairman, his or her annual salary shall be not more than $25,000.

For individuals who first become a member of the Board on or after the effective date of this amendatory Act of the 98th General Assembly, no service or contribution shall be credited in any retirement system or pension fund, under the Illinois Pension Code or otherwise, for service on the Board, and no public funds shall be appropriated, expended, or otherwise obligated for such a retirement system or pension fund credit. For terms of office beginning on or after the effective date of this amendatory Act of the 98th General Assembly, neither the chairperson nor any other member of the Board shall be entitled to participate in a program of life or health insurance as a consequence of his or her service on the Board.

Section 25. The Regional Transportation Authority Act is amended by changing Sections 2.17, 3.04, 3A.06, and 3B.06 as follows:

Sec. 2.17. Employee Pensions.

(a) The Authority may establish and maintain systems of pensions and retirement benefits for such officers and employees of the Authority as may be designated or described by ordinance of the Authority; may fix the classifications therein; may take such steps as may be necessary to provide that persons eligible for admission to such pension systems as officers and employees of the Authority or of any transportation agency whose operations are financed in whole or in part by the Authority, shall retain eligibility for admission to or continued coverage and participation under Title II of the federal Social Security Act, as amended, and the related provisions of the Federal Insurance Contributions Act, as amended, or the federal Railroad Retirement Act, as amended, and the related provisions of the Railroad Retirement Tax Act, as amended, as the case may be; and may provide in connection with such pension systems, a system of benefits payable to the beneficiaries and dependents of any participant in such pension systems after the death of such participant (whether accidental or otherwise, whether occurring in the actual performance of duty or otherwise, or both) subject to such exceptions, conditions, restrictions and classifications as may be provided by ordinance of the Authority. Such pension systems shall be financed or funded by such means and in such manner as may be determined by the Authority to be economically feasible.

(b) Beginning on the effective date of this amendatory Act of the 98th General Assembly, the Authority shall not grant any new benefit increase. As used in this subsection (b), "new benefit increase" means (i) an increase in the amount of any benefit provided under the authority of an ordinance adopted under this Section that takes effect after the effective date of this amendatory Act of the 98th General Assembly and (ii) an expansion of the conditions of eligibility for any benefit provided under the authority of an ordinance adopted under this Section that takes effect after the effective date of this amendatory Act of the 98th General Assembly.

Sec. 3.04. Compensation; pension; benefits. For terms of office beginning prior to the effective date of this amendatory Act of the 98th General Assembly, each Each Director including the Chairperson Chairman, except for the Chairman of the Chicago Transit Authority who shall not be compensated by the Authority, shall be compensated at the rate of $25,000 per year.

For terms of office beginning on or after the effective date of this amendatory Act of the 98th General Assembly, the Chairperson shall be compensated at the rate of $25,000 per year. For terms of office beginning on or after the effective date of this amendatory Act of the 98th General Assembly, each Director shall be compensated $500 for attendance at each meeting of the Board and each other meeting he or she is statutorily required to attend in his or her capacity as a Director, and for actual expenses incurred in travel to and from those meetings, but he or she shall not be otherwise compensated for service as a Director or Chairperson; provided that, for terms of office beginning on or after the effective date of this amendatory Act of the 98th General Assembly, the Chairman of the Chicago Transit Authority shall not be compensated by the Authority.

For individuals who first become members of the Board on or after the effective date of this amendatory Act of the 98th General Assembly, no service or contribution shall be credited in any retirement system or pension fund, under the Illinois Pension Code or otherwise, for service on the Board, and no public funds shall be appropriated, expended, or otherwise obligated for such a retirement system or pension fund credit. For terms of office beginning on or after the effective date of this amendatory Act of the 98th General Assembly, neither the Chairperson nor any other Director shall be entitled to participate in a program of life or health insurance as a consequence of his or her service on the Board.

Officers of the Authority shall not be required to comply with the requirements of the Public Funds Statement Publication Act "An Act requiring certain custodians of public moneys to file and publish statements of the receipts and disbursements thereof", approved June 24, 1919, as now or hereafter amended.

Sec. 3A.06. Compensation; pension; benefits. The Chairperson Chairman of the Suburban Bus Board shall receive an annual salary of $15,000. For terms of office beginning before the effective date of this amendatory Act of the 98th General Assembly, and the other members of the Suburban Bus Board shall receive an annual salary of $10,000. For terms of office beginning on or after the effective date of this amendatory Act of the 98th General Assembly, each member of the Suburban Bus Board, other than the Chairperson, shall be compensated $500 for attendance at each meeting of the Board and each other meeting he or she is statutorily required to attend in his or her capacity as a member of the Suburban Bus Board, and for actual expenses incurred in travel to and from those meetings, but he or she shall not be otherwise compensated for service as a member of the Board. Each member shall be reimbursed for actual expenses incurred in the performance of his duties, not to exceed $5000 per year.

For individuals who first become members of the Board on or after the effective date of this amendatory Act of the 98th General Assembly, no service or contribution shall be credited in any retirement system or pension fund, under the Illinois Pension Code or otherwise, for service on that Board, and no public funds shall be appropriated, expended, or otherwise obligated for such a retirement system or pension fund credit. For terms of office beginning on or after the effective date of this amendatory Act of the 98th General Assembly, neither the Chairperson nor any other member of the Board shall be entitled to participate in a program of life or health insurance as a consequence of his or her service on the Board.

Officers of the Division shall not be required to comply with the requirements of the Public Funds Statement Publication Act "An Act requiring certain custodians of public monies to file and publish statements of the receipts and disbursements thereof", approved June 24, 1919, as now or hereafter amended.
