<synopsistitle></synopsistitle>
<reference>New Act</reference><aliasreference></aliasreference><reference>30 ILCS 105/5.855 new</reference><aliasreference></aliasreference><SynopsisText>Creates the Illinois Secure Choice Savings Program Act. Establishes a retirement savings program in the form of an automatic enrollment payroll deduction IRA with the intent of promoting greater retirement savings for private-sector employees in a convenient, low-cost, and portable manner. Creates the Illinois Secure Choice Savings Program Fund consisting of moneys received from enrollees and participating employers. Sets forth the composition of the Board, the Board's duties, and provisions governing risk management, investment firms, and investment options. Provides for employee and employer information packets, as well as program implementation and enrollment. Provides that the State shall have no duty or liability to any party for the payment of any retirement savings benefits accrued by any individual under the Program. Requires annual reports and audits of the Program. Sets forth penalties. Amends the State Finance Act to create the Illinois Secure Choice Savings Program Fund. Effective immediately.</SynopsisText><synopsistitle>Senate Committee Amendment No. 1</synopsistitle>
<SynopsisText>Defines "IRA" as an individual retirement account under Section 408(a) or Section 408(b) of the Internal Revenue Code (rather than Section 408 of the Internal Revenue Code). Provides that the Board shall evaluate and establish the process by which an individual (rather than an individual or an employee of a non-participating employer) may voluntarily enroll in and make contributions to the Program.</SynopsisText><synopsistitle>Senate Committee Amendment No. 3</synopsistitle>
<SynopsisText>Provides that private funds or federal funding received under the Act in order to implement the Program until the fund is self-sustaining shall not be repaid unless those funds were offered contingent upon the promise of such repayment.</SynopsisText><synopsistitle>Senate Committee Amendment No. 4</synopsistitle>
<SynopsisText>Provides that the Board shall keep annual administrative expenses as low as possible, but in no event shall they exceed 0.75% (rather than 1%) of the total trust balance.</SynopsisText><synopsistitle>Senate Committee Amendment No. 5</synopsistitle>
<SynopsisText>Requires the Board to establish and maintain an Internet website designed to assist employers in identifying private sector providers of retirement arrangements that can be set up by the employer rather than allowing employee participation in the Program under this Act. Further provides that the Board shall only establish and maintain an Internet website if there is sufficient interest in such an Internet website by private sector providers and if the private sector providers furnish the funding necessary to establish and maintain the Internet website. Provides that the Board must provide public notice of the availability of and the process for inclusion in the Internet website before the Internet website becomes publicly available. Requires this Internet website to be available to the public before the Board opens the Program for enrollment. Provides that the Internet website address must be included on any Internet website posting or other materials regarding the Program offered to the public by the Board. Provides that the notification that the Program has been implemented shall include a statement that rather than enrolling employees in the Program under this Act, employers may sponsor an alternative arrangement, including, but not limited to, a defined benefit plan, 401(k) plan, a Simplified Employee Pension (SEP) plan, a Savings Incentive Match Plan for Employees (SIMPLE) plan, or an automatic payroll deduction IRA offered through a private provider.</SynopsisText><synopsistitle>Senate Committee Amendment No. 6</synopsistitle>
<SynopsisText>Provides that prior to opening the program for enrollment, the Board shall design and disseminate to all employers an employer information packet (rather than design and disseminate the packet through the Department). Sets forth a provision that the Board shall provide for the contents of both the employee and employer information packets (rather than the Department providing for the packets by rule).</SynopsisText><synopsistitle>Senate Committee Amendment No. 7</synopsistitle>
<SynopsisText>Establishes the Illinois Secure Choice Savings Program Fund as a trust outside of the State Treasury (currently a special fund in the State Treasury), with the Illinois Secure Choice Savings Board as its trustee. Provides that a section regarding fiduciary duty applies to the Illinois Secure Choice Savings Board, the individual members of the Board, the IRA trustee appointed by the Board, any other agents appointed or engaged by the Board, and Program staff (currently only individual members of the Board and Program staff).</SynopsisText><synopsistitle>Senate Floor Amendment No. 8</synopsistitle>
<SynopsisText>Provides that each appointment by the Governor shall be subject to approval by the State Treasurer, who, upon approval, shall certify his or her approval to the Secretary of State. Provides that in addition to the approval of the State Treasurer, each appointment shall also be subject to the advice and consent of the Senate. Further provides that in case of a vacancy during a recess of the Senate, the Governor shall make a temporary appointment until the next meeting of the Senate, at which time the Governor shall nominate some person to fill the office. Provides that if the State Treasurer does not approve or disapprove the appointment by the Governor within 60 session days (rather than 15 days) after receipt thereof, the person shall be deemed to have been approved by the State Treasurer. Further provides that any appointment that has not been acted upon by the Senate within 60 session days after the receipt thereof shall be deemed to have received the advice and consent of the Senate.</SynopsisText><synopsistitle>Senate Floor Amendment No. 9</synopsistitle>
<SynopsisText>Changes the number of employees to 25 or more (rather than 10 or more) within the definition of "employer". Makes a corresponding change to the definition of "small employer".</SynopsisText><synopsistitle>Senate Floor Amendment No. 10</synopsistitle>
<SynopsisText>Provides that the Board may not implement the Program if the IRA arrangements offered under the Program fail to qualify for the favorable federal income tax treatment ordinarily accorded to IRAs under the Internal Revenue Code or if it is determined that the program is an employee benefit plan and State or employer liability is established under the federal Employee Retirement Income Security Act.</SynopsisText><synopsistitle>House Committee Amendment No. 1</synopsistitle>
<SynopsisText>Provides that the Board may establish an annuity fund as an additional investment option. Makes technical changes.</SynopsisText><synopsistitle>House Committee Amendment No. 2</synopsistitle>
<SynopsisText>Defines "IRA" as a Roth IRA (individual retirement account) under Section 408A of the Internal Revenue Code (rather than an individual retirement account under Section 408(a) or Section 408(b) of the Internal Revenue Code). Provides that the Program shall be implemented, and enrollment of employees shall begin, within 24 months (rather than within 12 months) after the effective date of this Act. Deletes the immediate effective date. Provides that if the Board does not obtain adequate funds to implement the Program within the time frame set forth in the Act, the Board may delay the implementation of the Program. Prohibits the Board from otherwise delaying the implementation of the Program.</SynopsisText><synopsistitle>House Floor Amendment No. 3</synopsistitle>
