<reference>415 ILCS 5/9.1</reference><aliasreference>from Ch. 111 1/2, par. 1009.1</aliasreference><SynopsisText>Amends the Environmental Protection Act. Provides that if a complete application for the renewal of a Clean Air Act permit is submitted to the Illinois Environmental Protection Agency 90 or fewer days before the permit expires, then the applicant must pay a $5,000 late-filing fee and the terms and conditions of the permit must remain in effect until final administrative action has been taken by the Agency on that application. Provides that if a complete application for the renewal of a Clean Air Act permit is submitted after the permit expires, then the Agency may allow the terms and conditions of the permit to remain in effect, and, if that authorization is granted, then the applicant must pay a $10,000 late-filing fee.</SynopsisText><synopsistitle>Senate Floor Amendment No. 1</synopsistitle>

Amends the Environmental Protection Act. Deletes a provision which provides that if a complete application for a permit renewal is submitted to the Environmental Protection Agency at least 90 days prior to expiration of the permit, then all of the terms and conditions of the permit shall remain in effect until final administrative action has been taken on the application. Provides that, if, before the expiration of a State operating permit that contains federally enforceable conditions limiting the potential to emit of the source to a level below the major source threshold for that source so as to exclude the source from the Clean Air Act Permit Program, the Agency receives a complete application for the renewal of that permit, then all of the terms and conditions of the permit shall remain in effect until final administrative action has been taken on the application for the renewal of the permit.
