<synopsistitle></synopsistitle>
<reference>210 ILCS 135/9.5 new</reference><aliasreference></aliasreference><SynopsisText>Amends the Community-Integrated Living Arrangements Licensure and Certification Act. Provides that the Director of the Division of Developmental Disabilities within the Department of Human Services shall appoint a Community Regulatory Advisory Board to consult with the Department. Provides for Advisory Board membership. Requires that the Advisory Board meet at least 4 times each year. Provides that the Advisory Board shall advise the Department on all aspects of the Department's responsibilities under the Act, including the format and content of any rules proposed by the Division of Developmental Disabilities, as requested by the Department. Provides that with certain exceptions, no rule of the Department implementing the Act that is proposed by the Department on or after the effective date of the amendatory Act is valid or effective against any person or party, nor may it be invoked by the Department for any purpose, unless the Department has first sought the advice of the Advisory Board with respect to that rule. Provides that if the Department requests the Advisory Board's advice with respect to a proposed rule, and if the Advisory Board fails to advise the Department as to that proposed rule within 90 days after the Department's request, the Advisory Board shall be deemed to have given its approval of that proposed rule. Amends the Developmental Disability and Mental Disability Services Act. Creates the Developmental Disabilities Regulatory Advisory Board. Provides that the Director of the Division of Developmental Disabilities within the Department of Human Services shall appoint a Developmental Disabilities Regulatory Advisory Board, whose members are capable of actively participating on the Advisory Board, to consult with the Department regarding amendments to Parts 115, 116, 119, and 120 of Title 59 of the Illinois Administrative Code (standards and licensure requirements for community-integrated living arrangements, administration of medication in community settings, minimum standards for certification of developmental training programs, and medicaid home and community-based services waiver program for individuals with developmental disabilities). Provides that the Advisory Board shall advise the Department of Human Services Division of Developmental Disabilities on the format and content of any rules proposed by the Division of Developmental Disabilities within the Department. Provides that during its review of proposed rules as requested by the Department, the Advisory Board shall discuss the economic impact of those rules. Provides that if the Advisory Board, having been asked for its advice, fails to advise the Department within 45 days, the rules shall be considered acted upon. Provides that the Department of Human Services shall provide staff and technical support to the Advisory Board to perform its functions. Amends the Real Estate License Act of 2000. Defines "electronic means of proctoring" and "interactive delivery method". Provides that an individual holding an active license as a managing broker may return the license to the Department of Financial and Professional Regulation along with a form provided by the Department and shall be issued a broker's license in exchange. Removes language requiring that educational requirements involve interactive delivery methods presenting instruction and real time discussion between the instructor and the students. Provides that no licensee shall obtain any written brokerage agreement that does not either provide for automatic expiration within a definite period of time or provide the client with a right to terminate the agreement annually by giving no more than 30 days' prior written notice.
