| 6 | | unless the Department has submitted the criteria for |
| 7 | | determining the appropriateness of the transport for first |
| 8 | | notice publication in the Illinois Register pursuant to Section |
| 9 | | 5-40 of the Illinois Administrative Procedure Act.".
