1    AN ACT concerning regulation.

 
2    Be it enacted by the People of the State of Illinois, 
3represented in the General Assembly: 

 
4    Section 5. The Pharmacy Practice Act is amended by changing 
5Section 10 as follows:

7    (Section scheduled to be repealed on January 1, 2018)

8    Sec. 10. State Board of Pharmacy. There is created in the

9the Department the
State Board of Pharmacy.
It shall consist of 
109 members, 7 of whom shall be licensed pharmacists.
Each of 
11those 7 members must be a licensed pharmacist in good standing

12in this State, a graduate of an accredited college of pharmacy 
13or hold
a Bachelor of Science degree in Pharmacy and have at 
14least 5 years'
practical experience in the practice of pharmacy 
15subsequent to the
date of his licensure as a licensed 
16pharmacist in the State of Illinois.
There shall be 2 public 
17members, who shall be voting members, who
shall not be licensed 
18pharmacists in this State or any other state.
19    Each member shall be appointed by the Governor.

20    Members
 shall be appointed to 5 year terms.  The Governor 
21shall fill any vacancy for the remainder of the unexpired term. 
22Partial terms over 3 years in length shall be considered full 
23terms. A member may be reappointed for a successive term, but

1no member shall serve more than 2 full terms in his or her 
2lifetime.



3    In making the appointment of members on the Board, the 
4Governor shall
give due consideration to recommendations by the 
5members of the profession
of pharmacy and by pharmacy
 
6organizations therein.  The Governor
shall notify the pharmacy
 
7organizations promptly of any vacancy
of members on the Board 
8and in appointing members shall give consideration
to 
9individuals engaged in all types and settings of pharmacy 
10practice.

11    The Governor may remove any member of the Board for 
12misconduct, incapacity
or neglect of duty and he shall be the 
13sole judge of the sufficiency of the
cause for removal.

14    Each member of the Board shall be reimbursed for such 
15actual
and legitimate expenses as he may incur in going to and 
16from the place
of meeting and remaining thereat during sessions 
17of the Board.  In
addition, each member of the Board may
 receive 
18a per diem payment
in an amount determined from time to time by 
19the Director for attendance
at meetings of the Board and 
20conducting other official business of
the Board.

21    The Board shall hold quarterly meetings at such times and 
22places and upon
 notice as the Department

may determine and as 
23its business may require.
A majority of the Board members 
24currently appointed shall constitute a quorum. A vacancy in the 
25membership of the Board shall not impair the right of a quorum 
26to exercise all the rights and perform all the duties of the

1Board.


2    The Board shall exercise the rights, powers and duties 
3which have been
vested in the Board under this Act, and any 
4other duties conferred
upon the Board by law.
