Amends the Illinois Health Benefits Exchange Law. Provides that in no case shall the authority for establishing, administering, or operating a State-based health benefit exchange in Illinois be based upon an executive order issued by the Governor of Illinois. Effective immediately.

| 2 | | Be it enacted by the People of the State of Illinois,

| 3 | | represented in the General Assembly:

| 4 | | Section 5. The Illinois Health Benefits Exchange Law is |
| 5 | | amended by adding Section 5-30 as follows:

| 6 | | (215 ILCS 122/5-30 new) |
| 7 | | Sec. 5-30. Executive orders. In no case shall the authority |
| 8 | | for establishing, administering, or operating a State-based |
| 9 | | health benefit exchange in Illinois be based upon an executive |
| 10 | | order issued by the Governor of Illinois.

| 11 | | Section 99. Effective date. This Act takes effect upon |
| 12 | | becoming law.
