| 1 | | AN ACT concerning service dogs.
|
| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:
|
| 4 | | Section 5. The School Code is amended by changing Section |
| 5 | | 14-6.02 as follows:
|
| 6 | | (105 ILCS 5/14-6.02) (from Ch. 122, par. 14-6.02)
|
| 7 | | Sec. 14-6.02. Service animals. Service animals such as |
| 8 | | guide dogs,
signal dogs or any other animal individually |
| 9 | | trained to perform tasks for
the benefit of a student with a |
| 10 | | disability shall be permitted to accompany
that student at all |
| 11 | | school functions, whether in or outside the classroom. For |
| 12 | | purposes of this Section, "service animal" includes, but is not |
| 13 | | limited to an animal trained or is being trained as: a hearing |
| 14 | | animal; a guide animal; an assistance animal; a seizure alert |
| 15 | | animal; a mobility animal; a psychiatric service animal; or an |
| 16 | | autism service animal.

When a blind, hearing impaired, or physically |
| 8 | | handicapped
person, mobility impaired person, a person with a |
| 9 | | psychiatric condition, or a person who is subject to epilepsy |
| 10 | | or other seizure disorders, or a person diagnosed with an |
| 11 | | autism spectrum disorder is
accompanied by a dog which serves |
| 12 | | as a guide, leader, seizure-alert, or
seizure-response, |
| 13 | | mobility animal, a psychiatric service animal, or autism |
| 14 | | service dog for such person or when a trainer of a guide, |
| 15 | | leader,
seizure-alert, or seizure-response, mobility animal; a |
| 16 | | psychiatric service animal, or autism service dog is |
| 17 | | accompanied by a guide, leader,
seizure-alert, or |
| 18 | | seizure-response dog, mobility animal, psychiatric service, or |
| 19 | | autism service dog or a dog that is being trained to be a
|
| 20 | | guide, leader, seizure-alert, or seizure-response dog, |
| 21 | | mobility, psychiatric service, or autism service dog, neither |
| 22 | | the person nor
the dog shall be denied the right of entry and |
| 23 | | use of facilities of any public
place of accommodation as |
| 24 | | defined in Section 5-101 of the "Illinois Human
Rights Act", if |

| 1 | | such dog is wearing a harness, backpack, or vest identifying |
| 2 | | the dog as a trained service dog and such person presents
|
| 3 | | credentials for inspection issued by a school for training |
| 4 | | guide, leader,
seizure-alert, or seizure-response, or autism |
| 5 | | service dogs.
|
| 6 | | Any violation of this Act is a Class C misdemeanor.
|
