| 1 | | AN ACT concerning transportation.

| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:

| 4 | | Section 5. The Illinois Highway Code is amended by changing |
| 5 | | Section 9-113.02 as follows:
|
| 6 | | (605 ILCS 5/9-113.02) |
| 7 | | Sec. 9-113.02. Damage to State-owned or local |
| 8 | | government-owned roadway property. Any agency or |
| 9 | | instrumentality of the State of Illinois or unit of local |
| 10 | | government may seek recovery for the cost of the repair or |
| 11 | | replacement of damaged or destroyed roadway property. As used |
| 12 | | in this Section, "roadway property" includes road safety |
| 13 | | equipment and emergency equipment. Depreciation may not be used |
| 14 | | as a factor in determining the cost of the damaged or destroyed |
| 15 | | roadway property for which recovery is sought.
