ILCON Art. VII, Sec. 2







    Proposes to amend the Local Government Article of the Illinois Constitution. Provides that a single township or two or more contiguous townships may be disconnected from Cook County and may form a new county. Provides that the disconnection must be approved by referendum adopted by a majority of the votes cast on the proposition in the township or townships, as applicable. Effective upon being declared adopted.

CONSTITUTIONAL AMENDMENT

    RESOLVED, BY THE SENATE OF THE NINETY-SIXTH GENERAL 
4
ASSEMBLY OF THE STATE OF ILLINOIS, THE HOUSE OF REPRESENTATIVES 
5
CONCURRING HEREIN, that there shall be submitted to the 
6
electors of the State for adoption or rejection at the general 
7
election next occurring at least 6 months after the adoption of 
8
this resolution a proposition to amend Article VII of the 
9
Illinois Constitution by changing Section 2 as follows:

SECTION 2. COUNTY TERRITORY, BOUNDARIES AND SEATS

    (a) The General Assembly shall provide by law for the 
15
formation,
consolidation, merger, division, and dissolution of 
16
counties, and for
the transfer of territory between counties.

17
    (b) County boundaries shall not be changed unless approved 
18
by
referendum in each county affected, except as provided in 
19
subsection (d).

    (c) County seats shall not be changed unless approved by

21
three-fifths of those voting on the question in a county-wide

22
referendum.

    (d) In Cook County, a single township or two or more

contiguous townships may be disconnected from Cook County and 
2
form a new county. The disconnection must be approved by 
3
referendum adopted by a majority of the votes cast on the 
4
proposition in the township or townships, as applicable.  The 
5
referendum may be initiated by ordinance of the township or 
6
townships, as applicable, or by petition signed by at least ten 
7
percent of the electors of the township or townships, as 
8
applicable, and the referendum shall be conducted, all as 
9
provided by law.

SCHEDULE

    This Constitutional Amendment takes effect upon being 
13
declared adopted in accordance with Section 7 of the Illinois 
14
Constitutional Amendment Act.
