| 2 | | AMENDMENT NO. ______. Amend Senate Bill 3778, AS AMENDED, |
| 3 | | by replacing everything after the enacting clause with the |
| 4 | | following:
|
| 5 | | "Section 5. The Downstate Public Transportation Act is |
| 6 | | amended by changing Section 2-15.2 as follows: |
| 7 | | (30 ILCS 740/2-15.2) |
| 8 | | Sec. 2-15.2. Free services; eligibility. |
| 9 | | (a) (Blank). Notwithstanding any law to the contrary, no |
| 10 | | later than 60 days following the effective date of this |
| 11 | | amendatory Act of the 95th General Assembly, any fixed route |
| 12 | | public transportation services provided by, or under grant or |
| 13 | | purchase of service contracts of, every participant, as defined |
| 14 | | in Section 2-2.02 (1)(a), shall be provided without charge to |
| 15 | | all senior citizen residents of the participant aged 65 and |
| 16 | | older, under such conditions as shall be prescribed by the |
|

| 1 | | participant. |
| 2 | | (b) Notwithstanding any law to the contrary, on or after |
| 3 | | the effective date of this amendatory Act of the 96th General |
| 4 | | Assembly, any fixed route public transportation services |
| 5 | | provided by, or under grant or purchase of service contracts |
| 6 | | of, every participant, as defined in Section 2-2.02 (1)(a), |
| 7 | | shall be provided without charge to any person aged 65 or older |
| 8 | | who meets the income eligibility limitation set forth in |
| 9 | | subsection (a-5) of Section 4 of the Senior Citizens and |
| 10 | | Disabled Persons Property Tax Relief and Pharmaceutical |
| 11 | | Assistance Act, under such conditions as shall be prescribed by |
| 12 | | the participant. The Department on Aging shall furnish all |
| 13 | | information reasonably necessary to determine eligibility, |
| 14 | | including updated lists of individuals who are eligible for |
| 15 | | services without charge under this Section. |
| 16 | | (c) In addition, any fixed route public transportation |
| 17 | | services shall also be provided free of charge to any person |
| 18 | | aged 65 or older who possesses a valid fare card or other form |
| 19 | | of verification issued by the participant that authorizes the |
| 20 | | person to receive free services on or before the effective date |
| 21 | | of this amendatory Act of the 96th General Assembly. If a |
| 22 | | person meets the requirements of this subsection, then the |
| 23 | | person may continue to receive free services until the |
| 24 | | expiration date on the fare card or other form of verification. |
| 25 | | If a person meets the requirements of this subsection but the |
| 26 | | valid fare card or other form of verification does not have an |

| 1 | | expiration date, then the person may continue to receive free |
| 2 | | services for 4 years after the effective date of this |
| 3 | | amendatory Act of the 96th General Assembly. This subsection |
| 4 | | applies to persons aged 65 or older who do not qualify under |
| 5 | | subsection (b). |
| 6 | | (d) Nothing in this Section shall relieve the participant |
| 7 | | from providing reduced fares as may be required by federal law.

| 9 | | Section 10. The Metropolitan Transit Authority Act is |
| 10 | | amended by changing Section 51 as follows: |
| 11 | | (70 ILCS 3605/51) |
| 12 | | Sec. 51. Free services; eligibility. |
| 13 | | (a) (Blank). Notwithstanding any law to the contrary, no |
| 14 | | later than 60 days following the effective date of this |
| 15 | | amendatory Act of the 95th General Assembly, any fixed route |
| 16 | | public transportation services provided by, or under grant or |
| 17 | | purchase of service contracts of, the Board shall be provided |
| 18 | | without charge to all senior citizens of the Metropolitan |
| 19 | | Region (as such term is defined in 70 ILCS 3615/1.03) aged 65 |
| 20 | | and older, under such conditions as shall be prescribed by the |
| 21 | | Board.

| 22 | | (b) Notwithstanding any law to the contrary, on or after |
| 23 | | the effective date of this amendatory Act of the 96th General |
| 24 | | Assembly, any fixed route public transportation services |

| 20 | | the fare card or other form of verification. If a person meets |

| 22 | | other form of verification does not have an expiration date, |
| 23 | | then the person may continue to receive free services for 4 |
| 24 | | years after the effective date of this amendatory Act of the |
| 25 | | 96th General Assembly. This subsection applies to persons aged |
| 26 | | 65 or older who do not qualify under subsection (b). |

| 5 | | by changing Section 8.6 as follows: |

| 7 | | Sec. 8.6. Free services; eligibility. |
| 8 | | (a) (Blank). Notwithstanding any law to the contrary, no |
| 9 | | later than 60 days following the effective date of this |
| 10 | | amendatory Act of the 95th General Assembly, any fixed route |
| 11 | | public transportation services provided by, or under grant or |
| 12 | | purchase of service contracts of, every District shall be |
| 13 | | provided without charge to all senior citizens of the District |
| 14 | | aged 65 and older, under such conditions as shall be prescribed |
| 15 | | by the District.

| 25 | | amended by changing Sections 3A.15 and 3B.14 as follows: |

| 11 | | (b) Notwithstanding any law to the contrary, on or after |
| 12 | | the effective date of this amendatory Act of the 96th General |
| 13 | | Assembly, any fixed route public transportation services |
| 14 | | provided by, or under grant or purchase of service contracts |
| 15 | | of, the Suburban Bus Board shall be provided without charge to |
| 16 | | any person aged 65 or older who meets the income eligibility |
| 17 | | limitation set forth in subsection (a-5) of Section 4 of the |
| 18 | | Senior Citizens and Disabled Persons Property Tax Relief and |
| 19 | | Pharmaceutical Assistance Act, under such conditions as shall |
| 20 | | be prescribed by the Suburban Bus Board. The Department on |

| 5 | | (b) Notwithstanding any law to the contrary, on or after |
| 6 | | the effective date of this amendatory Act of the 96th General |
| 7 | | Assembly, any fixed route public transportation services |
| 8 | | provided by, or under grant or purchase of service contracts |
| 9 | | of, the Commuter Rail Board shall be provided without charge to |
| 10 | | any person aged 65 or older who meets the income eligibility |
| 11 | | limitation set forth in subsection (a-5) of Section 4 of the |
| 12 | | Senior Citizens and Disabled Persons Property Tax Relief and |
| 13 | | Pharmaceutical Assistance Act, under such conditions as shall |

| 13 | | Section 99. Effective date. This Act takes effect upon |
| 14 | | becoming law.".
