| AN ACT concerning health.
|

| Be it enacted by the People of the State of Illinois,
|
| 3 |
| represented in the General Assembly:
|

| Section 5. The Smoke Free Illinois Act is amended by |
| 5 |
| changing Section 40 as follows: |
| 6 |
| (410 ILCS 82/40)
|
| 7 |
| Sec. 40. Enforcement; complaints. |
| 8 |
| (a) The Department, State-certified local public health |
| 9 |
| departments, and local law enforcement agencies shall enforce |
| 10 |
| the provisions of this Act and may assess fines pursuant to |
| 11 |
| Section 45 of this Act. |
| 12 |
| (b) Any person may register a complaint with the |
| 13 |
| Department, a State-certified local public health department, |
| 14 |
| or a local law enforcement agency for a violation of this Act. |
| 15 |
| A person must disclose his or her name when registering a |
| 16 |
| complaint. The Department shall establish a telephone number |
| 17 |
| that a person may call to register a complaint under this |
| 18 |
| subsection (b).

| Section 99. Effective date. This Act takes effect upon |

| becoming law.
