AMENDMENT TO SENATE BILL 2186

    AMENDMENT NO. ______. Amend Senate Bill 2186 by replacing

everything after the enacting clause with the following:

    "Section 5. The Illinois Municipal Code is amended  by 
5
adding Section 11-13-27 as follows:

    (65 ILCS 5/11-13-27  new)
7
    Sec. 11-13-27. Retailers. No municipality or public body 
8
appointed by the corporate authorities of a municipality may 
9
enact any ordinance, resolution, or zoning decision to prohibit 
10
or otherwise restrict a retailer from locating within the 
11
municipality if the retailer otherwise meets all necessary 
12
requirements for construction and development. This 
13
prohibition does not include provisions that are unrelated to 
14
the location of the retailer including but not limited to wage 
15
requirements.   For the purposes of this Section, "retailer" 
16
means any company that operates or is seeking approval to

operate a retail store located within the geographic boundaries 
2
of the municipality.

    This Section is a limitation under subsection (i) of 
4
Section 6  of Article VII of the Illinois Constitution on the 
5
concurrent exercise by home rule units of powers and functions 
6
exercised by the State.

    Section 99. Effective date. This Act takes effect upon 
8
becoming law.".
