| AN ACT concerning public employee benefits.

| Be it enacted by the People of the State of Illinois,
|

| represented in the General Assembly:
|

| Section 5. The Illinois Pension Code is amended by adding |
| 5 |
| Section 3-113.2 as follows:
|

| (40 ILCS 5/3-113.2 new) |
| 7 |
| Sec. 3-113.2. Dependent beneficiaries; payment to trust. |
| 8 |
| Any benefit to be received by or paid to a dependent |
| 9 |
| beneficiary may be received by or paid to a trust established |
| 10 |
| for such dependent beneficiary if the dependent beneficiary is |
| 11 |
| living at the time such benefit would be received by or paid to |
| 12 |
| such trust.

| Section 99. Effective date. This Act takes effect upon |
| 14 |
| becoming law.
