| 1 | AMENDMENT TO SENATE BILL 139

| 2 | AMENDMENT NO. ______. Amend Senate Bill 139, AS AMENDED, by | ||||||
| 3 | replacing everything after the enacting clause with the | ||||||
| 4 | following:
| ||||||
| 5 | "Section 5. The Humane Care for Animals Act is amended by | ||||||
| 6 | changing Section 4 as follows:
| ||||||
| 7 | (510 ILCS 70/4) (from Ch. 8, par. 704)
| ||||||
| 8 | Sec. 4. Prohibited acts. | ||||||
| 9 | (a) No person may sell, offer for sale, barter,
or give | ||||||
| 10 | away as a pet or a novelty any rabbit or any baby chick, | ||||||
| 11 | duckling or
other fowl which has been dyed, colored, or | ||||||
| 12 | otherwise treated to impart an
artificial color thereto. Baby | ||||||
| 13 | chicks or ducklings shall not be sold, offered
for sale, | ||||||
| 14 | bartered, or given away as pets or novelties. Rabbits, | ||||||
| 15 | ducklings
or baby chicks shall not be awarded as prizes.
| ||||||
| 16 | (b) No person may perform an ear-cropping or tail-docking | ||||||
| |||||||
| |||||||
| 1 | procedure on any dog within the State or arrange to have an | ||||||
| 2 | ear-cropping or tail-docking procedure performed on any dog | ||||||
| 3 | within the State. However, the prohibition in this subsection | ||||||
| 4 | (b) shall not prevent a licensed veterinarian from performing | ||||||
| 5 | ear-cropping or tail-docking procedures for medical purposes, | ||||||
| 6 | and nothing in this subsection (b) shall be construed to | ||||||
| 7 | prohibit: (i) showing a dog with cropped ears or a docked tail | ||||||
| 8 | in a dog show or competition, (ii) owning or harboring a dog | ||||||
| 9 | with cropped ears or a docked tail, or (iii) selling, buying, | ||||||
| 10 | or adopting a dog with cropped ears or a docked tail. | ||||||
| 11 | (c) A person convicted of violating this Section is guilty | ||||||
| 12 | of a Class B
misdemeanor. A second or subsequent violation is a | ||||||
| 13 | Class 4 felony, with
every day that a violation continues | ||||||
| 14 | constituting a separate offense.
