SYNOPSIS AS INTRODUCED:

225 ILCS 320/35.5 new

Amends the Illinois Plumbing License Law. Provides that, if a unit of local government regulates reclaimed water systems, then those reclaimed water systems must meet specific requirements. Effective immediately.

A BILL FOR

AN ACT concerning regulation.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Illinois Plumbing License Law is amended by adding Section 35.5 as follows:

(225 ILCS 320/35.5 new)

Sec. 35.5. Reclaimed water recycling systems; exemption for governmental units.

(a) For purposes of this Act, "reclaimed water" means a combination of harvested storm (raw) water, domestic potable water, and condensated water from air conditioning systems.

(b) If a unit of local government regulates reclaimed water systems, then those reclaimed water systems must meet the requirements of this Section.

(c) Reclaimed water systems must meet all of the following requirements:

(1) All reclaimed water recycling systems must comply with the provisions of the Illinois Plumbing Code, 77 Ill. Adm. Code 890.

(2) Above-ground drain, waste, and vent piping for reclaimed water systems must conform to accepted standards listed in Table A of Appendix A of 77 Ill. Adm. Code 890. Reclaimed water, underground building drainage, and vent pipe must conform to one of the standards listed in Table A of Appendix A of 77 Ill. Adm. Code 890.

(3) The drain, waste, and vent piping for any reclaimed water system must be tested in accordance with 77 Ill. Adm. Code 890.1910.

(4) All reclaimed water systems must be inspected in accordance with 77 Ill. Adm. Code 890.1910.

(5) Only connections in accordance with this Section may be made between a reclaimed water system and a potable water system.

(6) Reclaimed water systems must receive only the water discharge of gutters, downspouts, roof drains, AC condensate drains, and potable water system.

(7) Reclaimed water must be collected in a reservoir constructed of durable, nonabsorbent, and corrosion-resistant materials. The reservoir must be a closed and vented vessel. Access openings must be provided to allow inspection and cleaning of the reservoir interior.

(8) Harvested rain water entering the reservoir must pass through an approved filter, such as a media, or mesh screen.

(9) An air gap must be installed downstream of the potable water fill line connection to the collection reservoir.

(10) The collection reservoir must be equipped with an overflow pipe having the same or larger diameter as the influent pipe for the harvested storm water. The overflow pipe must be indirectly connected to drainage swale or storm sewer.

(11) The reservoir must be provided with a vent sized in accordance with Department requirements and based on the diameter of the reservoir influent pipe.

(d) Systems for flushing water closets and urinals must meet all of the following requirements:

(1) The holding capacity of the reservoir must be a minimum of twice the volume of water required to meet the daily flushing requirements of the fixtures supplied with reclaimed water, but not less than 50 gallons (189 Liters).

(2) Reclaimed water must be disinfected by a method approved by the Department that employs one or more disinfectants such as chlorine, iodine, or ozone.

(3) Potable water must be supplied as a source of makeup water for the reclaimed water system. The potable water supply must be protected against backflow in accordance with 77 Ill. Adm. Code 890.1110.

(4) The reclaimed water must be dyed blue or green with a food grade vegetable dye before such water is supplied to the fixtures.

(5) Distribution piping must conform to one of the standards listed in Table A of Appendix A of 77 Ill. Adm. Code 890.

(6) Distribution piping and reservoirs must be identified as containing non-potable water. Distribution fittings to be identified with signs. Piping identification must be in accordance with 77 Ill. Adm. Code 890.1120.

(e) Surface landscape irrigation systems must meet all of the following requirements:

(1) Reservoirs must be sized to maintain a 2-day supply of irrigation water.

(2) The reservoir must be identified as containing non-potable water.

(3) A check valve and a full-open valve located on the discharge side of the check valve must be installed on the effluent pipe of the collections reservoir.

(4) Makeup water is not required for surface landscape irrigation systems. Where makeup water is provided, the installation must be in accordance with paragraph (3) of subsection (d) of this Section.

(5) Disinfection is not required for reclaimed water used for surface landscape irrigation systems.

(6) Reclaimed water used for surface landscape irrigation systems is not required to be dyed.

(7) The system must be sized in accordance with standards set by the Department.

(f) Nothing in this Act prohibits the State or any governmental unit from installing and using a reclaimed water recycling system, including systems for flushing of water closets and urinals and surface landscape irrigation systems. However, any reclaimed water recycling system must be in accordance with the requirements of this Section.

Section 99. Effective date. This Act takes effect upon becoming law.
