HOUSE JOINT RESOLUTION

    WHEREAS, The State Board of Education has filed its Report 
3
on Waiver of
School Code Mandates, dated March 1, 2010, with 
4
the Senate, the House of
Representatives, and the Secretary of 
5
State of Illinois as required by Section
2-3.25g of the School 
6
Code; therefore, be it

 
7
    RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE 
8
NINETY-SIXTH GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, THE 
9
SENATE CONCURRING HEREIN, that the appeal of an administrative 
10
rule waiver request made by Elgin SD 46 - Kane with respect to 
11
transitional bilingual education that was denied by the State 
12
Board of Education, identified in the report filed by the State 
13
Board of Education as request WM200-5289-3A, is denied; and be 
14
it further

 
15
    RESOLVED, That each of the school district waiver requests 
16
identified below by school district name and by the identifying 
17
number and subject area of the waiver request as summarized in 
18
the report filed by the State Board of Education is approved 
19
for only one year and disapproved for the remaining years:
20
        (1) Reavis THSD 220 - Cook, WM100-5243, driver 
21
    education - behind-the-wheel instruction;
22
        (2) Maine THSD 207 - Cook, WM100-5251-2, driver 
23
    education - behind-the-wheel instruction;

        (3) Wheaton CUSD 200 - DuPage, WM100-5269, driver

    education - behind-the-wheel instruction;

        (4) Moline USD 40 - Rock Island, WM100-5282-2, driver

        (5) Lyons THSD 204 - Cook, WM100-5286, driver education -
6
     behind-the-wheel instruction;
7
        (6) Triad CUSD 2 - Madison, WM100-5305, driver 
8
    education - behind-the-wheel instruction; and
9
        (7) Thornton Fractional THSD 215 - Cook, WM100-5320-1, 
10
    driver education - behind-the-wheel instruction; and be it 
11
    further

    RESOLVED, That the request made by Elgin SD U-46 - Kane 
13
with respect to driver education - behind-the-wheel 
14
instruction, identified in the report filed by the State Board 
15
of Education as request WM100-5289-2, is approved for only one 
16
year and for the substitution of only 4 hours of 
17
behind-the-wheel instruction with 16 hours of simulator use and 
18
is disapproved for the remaining years and hour; and be it 
19
further;

    RESOLVED, That the request made by Palatine CCSD 15 - Cook 
21
with respect to physical education, identified in the report 
22
filed by the State Board of Education as request WM100-5294, is 
23
approved; however, this approval shall not be interpreted as 
24
General Assembly approval of the merits of the district's
