| 1 | AN ACT concerning elections.
| |||||||||||||||||||||
| 2 | Be it enacted by the People of the State of Illinois,
| |||||||||||||||||||||
| 3 | represented in the General Assembly:
| |||||||||||||||||||||
| 4 | Section 5. The Election Code is amended by changing | |||||||||||||||||||||
| 5 | Sections 19A-10 and 19A-15 as follows: | |||||||||||||||||||||
| 6 | (10 ILCS 5/19A-10)
| |||||||||||||||||||||
| 7 | Sec. 19A-10. Permanent polling places for early voting.
| |||||||||||||||||||||
| 8 | (a) Each election authority shall designate at least one | |||||||||||||||||||||
| 9 | permanent polling place for early voting. The primary office of | |||||||||||||||||||||
| 10 | an election authority is a permanent polling place for early | |||||||||||||||||||||
| 11 | voting, unless an election authority establishes An election | |||||||||||||||||||||
| 12 | authority may establish permanent polling places for early
| |||||||||||||||||||||
| 13 | voting by personal appearance at locations throughout the | |||||||||||||||||||||
| 14 | election authority's
jurisdiction, including but not limited | |||||||||||||||||||||
| 15 | to a municipal clerk's office, a township clerk's office, a | |||||||||||||||||||||
| 16 | road district clerk's office, or a county or local public | |||||||||||||||||||||
| 17 | agency office. Except as otherwise provided in subsection (b), | |||||||||||||||||||||
| 18 | any person
entitled to vote early by personal appearance may do | |||||||||||||||||||||
| 19 | so at any polling place
established for early voting.

| 20 | (b) If it is impractical for the election authority to | |||||||||||||||||||||
| 21 | provide at each
polling place for early voting a ballot in | |||||||||||||||||||||
| 22 | every form required in the election
authority's jurisdiction, | |||||||||||||||||||||
| 23 | the election authority may:
| |||||||||||||||||||||
| |||||||
| |||||||
| 1 | (1) provide appropriate forms of ballots to the office | ||||||
| 2 | of the municipal
clerk in a municipality not having a board | ||||||
| 3 | of election commissioners; the
township clerk; or in | ||||||
| 4 | counties not under township organization, the road
| ||||||
| 5 | district clerk; and
| ||||||
| 6 | (2) limit voting at that polling place to registered | ||||||
| 7 | voters in that
municipality, ward or group of wards, | ||||||
| 8 | township, or road district.
| ||||||
| 9 | If the early voting polling place does not have the correct | ||||||
| 10 | ballot form for a person seeking to vote early, the election | ||||||
| 11 | judge or election official conducting early voting at that | ||||||
| 12 | polling place shall inform the person of that fact, give the | ||||||
| 13 | person the appropriate telephone number of the election | ||||||
| 14 | authority in order to locate an early voting polling place with | ||||||
| 15 | the correct ballot form for use in that person's assigned | ||||||
| 16 | precinct, and instruct the person to go to the proper early | ||||||
| 17 | voting polling place to vote early.
| ||||||
| 18 | (c) During each general primary and general election, each | ||||||
| 19 | election authority in a county with a population over 250,000 | ||||||
| 20 | shall establish at least one polling place for early voting by | ||||||
| 21 | personal appearance at a location within each of the 3 largest | ||||||
| 22 | municipalities within its jurisdiction. If any of the 3 largest | ||||||
| 23 | municipalities is over 80,000, the election authority shall | ||||||
| 24 | establish at least 2 polling places within the municipality. | ||||||
| 25 | All population figures shall be determined by the federal | ||||||
| 26 | census.

| 1 | During each general primary and general election, each | ||||||
| 2 | board of election commissioners established under Article 6 of | ||||||
| 3 | this Code in any city, village, or incorporated town with a | ||||||
| 4 | population over 100,000 shall establish at least 2 polling | ||||||
| 5 | places for early voting by personal appearance. All population | ||||||
| 6 | figures shall be determined by the federal census.

| 9 | Sec. 19A-15. Period for early voting; hours.
| ||||||
| 10 | (a) The period for early voting by personal appearance | ||||||
| 11 | begins the 22nd day preceding a general primary, consolidated | ||||||
| 12 | primary, consolidated, or
general election and extends through | ||||||
| 13 | the 5th day before election day.
| ||||||
| 14 | (b) A permanent polling place for early voting must remain | ||||||
| 15 | open during the
hours of 8:30 a.m. to 4:30 p.m., or 9:00 a.m. | ||||||
| 16 | to 5:00 p.m., on weekdays and
9:00 a.m. to 12:00 p.m. on | ||||||
| 17 | Saturdays, Sundays, and holidays, except a permanent polling | ||||||
| 18 | place must remain open during the hours of 8:30 a.m. to 4:30 | ||||||
| 19 | p.m. or 9:00 a.m. to until 5:00 p.m. on the final Saturday and | ||||||
| 20 | Sunday of the early voting period.
