SYNOPSIS AS INTRODUCED:
 		














40 ILCS 5/3-108.3









    Amends the Downstate Police Article of the Illinois Pension Code. Provides that, if a special needs trust has been established for a disabled adult child, then the special needs trust may stand in lieu of the disabled adult child as  a beneficiary for the purposes of the Article. Effective immediately.

    AN ACT concerning public employee benefits.

    Be it enacted by the People of the State of Illinois,

represented in the General Assembly:

    Section 5. The Illinois Pension Code is amended  by changing 
5
Section 3-108.3 as follows:

    (40 ILCS 5/3-108.3)

    Sec. 3-108.3. Beneficiary. "Beneficiary": A person 
8
receiving benefits from
a pension fund, including, but not 
9
limited to, retired pensioners, disabled
pensioners, their 
10
surviving spouses, minor children, disabled children, and

11
dependent parents. If a special needs trust as described in 
12
Section 1396p(d)(4) of Title 42 of the United States Code, as 
13
amended from time to time, has been established for a disabled 
14
adult child, then the special needs trust may stand in lieu of 
15
the disabled adult child as  a beneficiary for the purposes of 
16
this Article.

    Section 99. Effective date. This Act takes effect upon
