Amends the Downstate Police Article of the Illinois Pension Code. Provides that, if a special needs trust has been established for a disabled adult child, then the special needs trust may stand in lieu of the disabled adult child as a beneficiary for the purposes of the Article. Effective immediately.

| AN ACT concerning public employee benefits.
|

| Be it enacted by the People of the State of Illinois,
|
| 3 |
| represented in the General Assembly:
|

| Section 5. The Illinois Pension Code is amended by changing |
| 5 |
| Section 3-108.3 as follows:
|
| 6 |
| (40 ILCS 5/3-108.3)
|
| 7 |
| Sec. 3-108.3. Beneficiary. "Beneficiary": A person |
| 8 |
| receiving benefits from
a pension fund, including, but not |
| 9 |
| limited to, retired pensioners, disabled
pensioners, their |
| 10 |
| surviving spouses, minor children, disabled children, and
|
| 11 |
| dependent parents. If a special needs trust as described in |
| 12 |
| Section 1396p(d)(4) of Title 42 of the United States Code, as |
| 13 |
| amended from time to time, has been established for a disabled |
| 14 |
| adult child, then the special needs trust may stand in lieu of |
| 15 |
| the disabled adult child as a beneficiary for the purposes of |
| 16 |
| this Article.

| Section 99. Effective date. This Act takes effect upon |
