AMENDMENT TO HOUSE BILL 917

    AMENDMENT NO. ______. Amend House Bill 917, AS AMENDED, by

replacing everything after the enacting clause with the 
4
following:

    "Section 5. The Illinois Public Aid Code is amended  by 
6
adding Section 11-4.1 as follows:
 
7
    (305 ILCS 5/11-4.1 new)
8
    Sec. 11-4.1.  Medical providers assisting with 
9
applications for medical assistance. A provider enrolled to 
10
provide medical assistance services may, upon the request of an 
11
individual, accompany, represent, and assist the individual in 
12
applying for medical assistance under Article V of this Code. 
13
If an individual is unable to request such assistance due to 
14
incapacity or mental incompetence and has no other 
15
representative willing or able to assist in the application 
16
process,  a facility licensed under the Nursing Home Care Act or

the MR/DD Community Care Act or certified under this Code is 
2
authorized to assist the individual in applying  for long-term 
3
care services.  Subject to the provisions of   the Free Healthcare 
4
Benefits Application Assistance Act, nothing in this Section 
5
shall be construed as prohibiting any individual or entity from 
6
assisting another individual in applying for medical 
7
assistance under Article V of this Code.

    Section 99. Effective date. This Act takes effect upon 
9
becoming law.".
