625 ILCS 5/6-205.3 new

Synopsis As Introduced
Amends the Illinois Vehicle Code. Provides that upon a first conviction of resisting or obstructing a peace officer under the Criminal Code of 1961 involving the operation of a motor vehicle, the Secretary of State must suspend the convicted person's driver's license for a period not exceeding 6 months, and upon a second or subsequent conviction of the same offense, the person's driver's license must be suspended for one year. Provides that upon a conviction of resisting or obstructing a peace officer involving the operation of a motor vehicle, the court must order the person to surrender his or her driver's license to the clerk of the court who must forward the suspended license to the Secretary of State. Effective immediately.

House Committee Amendment No. 1
Deletes provision that upon conviction of a person for resisting or obstructing a peace officer involving that person's operation of a motor vehicle, the court shall order the person to surrender his or her driver's license to the clerk of the court who shall forward the suspended license to the Secretary of State. Changes the effective date of the bill to January 1, 2010.

Senate Committee Amendment No. 1

Replaces everything after the enacting clause. Amends the Illinois Vehicle Code. Makes technical changes in a Section concerning mandatory revocation of a license or permit.

Senate Floor Amendment No. 2

	Adds reference to:
	625 ILCS 5/11-601.5

Replaces everything after the enacting clause. Amends the Illinois Vehicle Code. Provides that a person who drives a vehicle upon any highway at a speed that is 31 (rather than 30) miles per hour or more but less than 40 miles per hour in excess of the applicable maximum speed limit commits a Class B misdemeanor. Effective immediately.
