    AN ACT concerning education.

    Be it enacted by the People of the State of Illinois,
 
3
represented in the General Assembly:

    Section 5. The State Finance Act is amended  by adding 
5
Sections 5.719 and 5.720 as follows:
 
6
    (30 ILCS 105/5.719 new)

7
    Sec. 5.719. The Private College Academic Quality Assurance 
8
Fund.

    (30 ILCS 105/5.720 new)

    Sec. 5.720. The Academic Quality Assurance Fund.

    Section 7. The Public Community College Act is amended  by 
12
changing Section 7-17 as follows:

    (110 ILCS 805/7-17)  (from Ch. 122, par. 107-17)

    Sec. 7-17. Any member or officer of the board, any officer 
15
of the
city or any other person holding any trust or employment 
16
under the board
or city who wilfully violates any of the 
17
provisions of Sections 7-8 7-6
through 7-16 shall be guilty of 
18
a business offense and may be fined not
exceeding $10,000 and 
19
forfeits his right to and shall be removed from
his office, 
20
trust or employment. Any such member, officer or person is

liable for the amount of any loss or damage suffered by the 
2
board
resulting from his violation of any of those Sections, to 
3
be recovered
by the board or by any taxpayer in the name and 
4
for the benefit of the
board, in a civil action. Any taxpayer 
5
bringing an action
under this Section must file a bond for all 
6
costs, and is liable for all
costs taxed against the board in 
7
that suit. This Section does not bar
any other remedy.

    Section 8. The Public Community College Act is amended  by

repealing Sections 7-6 and 7-7.

    Section 10. The Private College Act is amended  by adding

Sections 14.5 and 14.10 as follows:

    Sec. 14.5. Fees.  Fees to cover the cost of reviewing 
17
applications for a certificate of approval to establish or 
18
operate a post-secondary educational institution may be set by 
19
the Board by rule.

    Rulemaking authority to implement this amendatory Act of 
21
the 95th General Assembly, if any, is conditioned on the rules 
22
being adopted in accordance with all provisions of the Illinois 
23
Administrative Procedure Act and all rules and procedures of

the Joint Committee on Administrative Rules; any purported rule

not so adopted, for whatever reason, is unauthorized.

    Sec. 14.10. Private College Academic Quality Assurance 
5
Fund. The Private College Academic Quality Assurance Fund is 
6
created as a special fund in the State treasury.  All fees 
7
collected for the administration and enforcement of this Act 
8
must be deposited into this Fund.  All money in the Fund must be 
9
used, subject to appropriation, by the Board to supplement 
10
support for the administration and enforcement of this Act and 
11
must not be used for any other purpose.

    Rulemaking authority to implement this amendatory Act of 
13
the 95th General Assembly, if any, is conditioned on the rules 
14
being adopted in accordance with all provisions of the Illinois 
15
Administrative Procedure Act and all rules and procedures of 
16
the Joint Committee on Administrative Rules; any purported rule 
17
not so adopted, for whatever reason, is unauthorized.

    Section 15. The Academic Degree Act is amended  by adding 
19
Sections 10.5 and 10.10 as follows:

    (110 ILCS 1010/10.5  new)

    Sec. 10.5. Fees. Fees to cover the cost of reviewing 
22
applications for authorization to operate and for 
23
authorization to grant degrees may be set by the Board by rule.

    Sec. 10.10. Academic Quality Assurance Fund. The Academic

Quality Assurance Fund is created as a special fund in the

enforcement of this Act must be deposited into this Fund.  All

money in the Fund must be used, subject to appropriation, by 
13
the Board to supplement support for the administration and 
14
enforcement of this Act and must not be used for any other 
15
purpose.
