| AMENDMENT TO SENATE BILL 2562

| AMENDMENT NO. ______. Amend Senate Bill 2562, AS AMENDED, |

| by replacing everything after the enacting clause with the |
| 4 |
| following:
|

| "Section 5. The Wildlife Code is amended by changing |
| 6 |
| Section 1.13 as follows:
|
| 7 |
| (520 ILCS 5/1.13) (from Ch. 61, par. 1.13)
|
| 8 |
| Sec. 1.13. The Department is authorized to issue a "Public |
| 9 |
| Hunting Grounds
for Waterfowl" daily usage stamp at a fee not |
| 10 |
| to exceed $10
for duck hunting areas, and not to exceed $15 for |
| 11 |
| Canada goose
hunting areas; and assess a daily "Public Hunting |
| 12 |
| Grounds for Pheasants" fee daily usage
stamp not to exceed $25 |
| 13 |
| ($35 for non-residents) in 2008 and increasing by $5 every |
| 14 |
| third year until the maximum fee is $50 ($60 for non-residents) |
| 15 |
| $15, such stamp to expire at the end of the day of issue.
Each |
| 16 |
| person shall obtain such a stamp from the Department to be |

| attached
to the permit card
assigned to a person, or pay the |
| 2 |
| daily fee to hunt pheasants, under the provisions of the rules |
| 3 |
| and regulations made
by the Department for the operation of |
| 4 |
| State Public Hunting Grounds. Rulemaking authority to |
| 5 |
| implement this amendatory Act of the 95th General Assembly, if |
| 6 |
| any, is conditioned on the rules being adopted in accordance |
| 7 |
| with all provisions of the Illinois Administrative Procedure |
| 8 |
| Act and all rules and procedures of the Joint Committee on |
| 9 |
| Administrative Rules; any purported rule not so adopted, for |
| 10 |
| whatever reason, is unauthorized.
|
| 11 |
| The Department is authorized to permit hunters to harvest |
| 12 |
| both male and
female hand reared pheasants released on such |
| 13 |
| public hunting grounds.
|
| 14 |
| The Department shall cause an administrative rule, setting
|
| 15 |
| forth the rules
and regulations for the operation of Public |
| 16 |
| Hunting Areas on lands and waters
owned or leased by this |
| 17 |
| State.
|

| Section 99. Effective date. This Act takes effect upon |

| becoming law.".
