| AN ACT concerning criminal law.
|

| Be it enacted by the People of the State of Illinois,
|
| 3 |
| represented in the General Assembly:
|

| Section 5. The Criminal Code of 1961 is amended by adding |
| 5 |
| Section 31-4.5 as follows:
|

| (720 ILCS 5/31-4.5 new) |
| 7 |
| Sec. 31-4.5. Obstructing identification. |
| 8 |
| (a) A person commits the offense of obstructing |
| 9 |
| identification when he or she intentionally or knowingly |
| 10 |
| furnishes a false or fictitious name, residence address, or |
| 11 |
| date of birth to a peace officer who has: |
| 12 |
| (1) lawfully arrested the person; |
| 13 |
| (2) lawfully detained the person; or |
| 14 |
| (3) requested the information from a person that the |
| 15 |
| peace officer has good cause to believe is a witness to a |
| 16 |
| criminal offense. |
| 17 |
| (b) Sentence. Obstructing identification is a Class A |
| 18 |
| misdemeanor.

| 19 |
| Section 99. Effective date. This Act takes effect January |
| 20 |
| 1, 2009.
