AMENDMENT TO SENATE BILL 2110

    AMENDMENT NO. ______. Amend Senate Bill 2110 on page 2, by 
3
replacing lines 2 through 12 with the following:

"performed for environmental remediation of real property at 
5
the following sites or facilities:
6
            (A) all sites or facilities that are listed as 
7
        proposed or final on the National Priorities List 
8
        pursuant to Section 105 of the Comprehensive 
9
        Environmental Response, Compensation and Liability Act 
10
        of 1980, as amended (42 U.S.C. 9601 et seq.);
11
            (B) all sites or facilities undergoing remediation 
12
        pursuant to an administrative order issued pursuant to 
13
        Section 106 of the Comprehensive Environmental 
14
        Response, Compensation and Liability Act of 1980, as 
15
        amended(42 U.S.C.9601 et seq.);
16
            (C) all sites or facilities that are owned or 
17
        operated by a department, agency, or instrumentality

        of the United States that are undergoing remediation

        pursuant to Section 120 of the Comprehensive 
3
        Environmental Response, Compensation and Liability Act 
4
        of 1980, as amended (42 U.S.C. 9601 et seq.);

            (D) all sites or facilities undergoing remediation 
6
        pursuant to a settlement agreement pursuant to Section 
7
        122 of the Comprehensive Environmental Response, 
8
        Compensation and Liability Act of 1980, as amended (42 
9
        U.S.C. 9601 et seq.);
10
            (E) all sites or facilities undergoing remediation 
11
        pursuant to Section 3008(h) of the Resource 
12
        Conservation and Recovery Act of 1976 (42 U.S.C. 6901 
13
        et seq.);
14
            (F) all sites or facilities undergoing remediation 
15
        pursuant to Section 7003 of the Resource Conservation 
16
        and Recovery Act of 1976 (42 U.S.C. 6901 et seq.); or
17
            (G) all sites or facilities undergoing remediation 
18
        pursuant to a court or board order issued pursuant to 
19
        the Illinois Environmental Protection Act (415 ILCS 
20
        5/) with the approval of the Agency."; and

on page 7, line 15, after "State", by inserting the following:
 
22
", including but not limited to interests compliant with 35 
23
Ill. Adm. Code 742, Subpart J.".
