| AMENDMENT TO SENATE BILL 1429

| AMENDMENT NO. ______. Amend Senate Bill 1429 as follows:

| on page 274, by replacing line 12 with the following: |

| "criteria of subsection (b), subsection (c), or subsection |
| 5 |
| (d)"; and
|
| 6 |
| on page 276, immediately below line 12, by inserting the |
| 7 |
| following: |
| 8 |
| "(d) Prewritten computer software that is transferred by a |
| 9 |
| license that meets the requirements of subsection (a) is exempt |
| 10 |
| from the tax imposed under this Act to the extent that it is |
| 11 |
| directly used by a person who is engaged primarily in the |
| 12 |
| business of a financial institution. |
| 13 |
| For the purpose of this subsection (d), "financial |
| 14 |
| institution" means a depository institution that is insured by |
| 15 |
| the Federal deposit Insurance Corporation and the subsidiaries |
| 16 |
| and affiliates of that depository institution.".
