AMENDMENT TO SENATE BILL 1370

    AMENDMENT NO. ______. Amend Senate Bill 1370, AS AMENDED,

with reference to page and line numbers of House Amendment No. 
4
1, on page 1, lines 4 and 5, by changing "If and only if Senate 
5
Bill 500 of the 95th General Assembly becomes law, then the" to 
6
"The"; and

on page 1, line 7, by changing "95SB0500enr, Sec. 35" to "410 
8
ILCS 82/35"; and

on page 3, by inserting after line 11 the following:
10
        (6) Any public place that meets the following criteria:
11
            (A) the  owner or operator can demonstrate to the 
12
        Department that a smoking area has been equipped with 
13
        air filtration or purification devices or similar 
14
        technologies that render the concentration of 
15
        respirable suspended particulate matter in the 
16
        non-smoking area equivalent to the concentration of

        respirable suspended particulate matter in the ambient 
2
        outdoor air for the relevant geographic area; and
3
            (B) the public place is located in:
4
                (i) the Village of Rosemont; or
5
                (ii) the area described in item (b)(3) of 
6
            Section 13 of the Metropolitan Pier and Exposition 
7
            Authority Act.
8
        The Department shall adopt rules specifying the types 
9
    of technologies that satisfy the requirements of this 
10
    paragraph  (6).; and

on page 3, line 12, by changing "95SB0500enr" to "P.A. 95-17, 
12
eff. 1-1-08".
